    Non disclosure imprisonment threat against RBSicon Data Controller!

    Consumer Action Group User -- Zooman was today granted an order in the Barrow on Furness county courticon in respect of the failure by the Royal Bank of Scotlandicon to comply with his disclosure request under the Data Protection Act.

    District judge Forester, making the order commented that had the claimant been able to supply him with the name of the data controller at the Royal Bank of Scotland that he would have added a threat of imprisonment for non-compliance.

    The Royal Bank of Scotland now has until January 2007 to comply with Zooman's Subject access requesticon. The District Judge has indicated that is the Bank has not complied with the order by that time that he may make an order for imprisonment of the RBS Data controller.

    I know it wouldn't help Zooman, but I can't but help but hope that RBSicon don't comply and that the judge makes good his threat

    16 April - complained at court failure to forward defence

    22nd September: Subject Access Request.
    4th November: No reply so LBA giving 7 days.

    Cap One

    22nd September: Subject Access Req.
    5th October: Letter saying no record of account!
    15th October: Replied telling them to try harder...
    22nd October: Subject Access Req acknowledged.

    I have had this prob with Barclaycard. SARicon sent Sept 3rd 2006, complaint to ICO 14th Nov 2006, they wrote to Barclaycard who now expect me to wait until mid Jan 2007. Well lbaicon sent 2nd Jan 2007 giving them 7 days. We'll see what they can come up with.

    If not then claim will be filed.
