    Hello
    Well - tomorrow it will be 40 days since I sent off my DPA request to Sainsburys.
    So I shall be drafting the DPA non compliance letter asking to reply within 7 days.
    Can someone confirm that this is the correct thing to do?

    BOS - Prelim letter del 19/5/06 LBA del. no response - filed 12/06
    Clydesdale Financial Services - Gave them their chances off to court we go!

    Thanks Skyrocket. I have some copies of my dpa letter and thought that I would send a copy with my follow up request. What happens if they dont' comply? Do you just file a claim with the court or do you ask for them to refund charges first?

    Yes, a seven-day warning is absolutely the correct thing to do. However this does assume that your Subject access requesticon was properly made in that it was in writing, addressed correctly, identified you correctly at least by your name address and account number and was accompanied by payment of £10. If any of this is missing and am afraid that it is not an effective SAR and you would have to begin again.

    Assuming you paid £10 in what form was it paid? Was it by cheque? If it was then do you know cheque has been cashed? If so when?

    Once you are certain that a valid SAR has been made then at the end of 40 days -- assuming that you are prepared to go to court -- then I would say the proper procedure is to serve a seven-day warning and then begin a claim. The claim is not difficult, it won't cost very much and in a case such as yours when no personal dataicon has been received, then the result is a foregone conclusion and I anticipate that it will never go to court you will simply and very suddenly it all your statements and also the return of your court fee.

    The most important thing about the exercise is that gives the organisation a shock which they clearly badly need.

    I sent a DPA request for credit card statements along with a cheque, I received them within a week or so and a credit of £10 on my credit card account!!

    Lloyds TSB, Total Charges £900, Claim Filed for £1379 - Settled

    Sainsbury's Bank Credit Card, Total Charges £90 - Settled.

    Hiya - yes I sent the letter to the address on my credit card statements and I also enclosed £10 letter. I am 99.9% certain that I have used the correct letter for the DPA and definitely included my name and account number. They have not cashed the cheque at all.

    I will send the 7 day follow up today, however the follow up looks really brief - is it the correct one? DPA non compliance letter 3?

    Sorry I haven't posted for a long time.

    I actually got caught up in a house move and basically have let this fall behind. Shortly after my last post I received the statements from SAinsburys (and Abbeyicon) but I haven't had chance to pursue it. Is it too late do you think to do it now?

    Also, I'm a bit unsure as to what letter I am supposed to send now?
    Can anyone help me?
