We did a deal with a trader the other day, we part exchanged our car and gave them some cash for a new car.

 

Everything seems to be fine but we have today received a call from the trader telling us that they have taken our car to their mechanic and the car should be scrapped, it never should've passed the last MOT, whoever did it was rubbish, and it's an imported car which they wouldn't normally take.

 

They are saying that they want the car we bought from them back and they will give us our car and money back.

 

Obviously, we don't want to do that. We certainly didn't know or think it wasn't road worthy and definitely not scrap as there is no way we would've used it especially with our children in it.

 

I've checked a photo we had of the log book for the old car and it says declared new at first registration which I thought meant that it was a UK car not an import but I just don't know.

 

Does anyone know where we stand legally with regards to this?

 

They didn't get a mechanic to look at our car before accepting it and didn't even test drive it just gave us an offer of a value which we accepted.

 

They have said that they won't send the logbook off now to the DVLA and when we said we were seeking advice they said that there isn't anything to get advice on, they want their car back

Have you got the new car yet or not??

If you have taken delivery then a polite jog on mate to the dealer.

If you have not taken delivery yet then what paperwork do you have

 

We have the green section of the V5, the MOT and a receipt for the purchase of the car

Consumer Rights Act 8 Contracts for transfer of goods

A contract to supply goods is a contract for transfer of goods if under it the trader transfers or agrees to transfer ownership of the goods to the consumer and—

 

(a) the consumer provides or agrees to provide consideration otherwise than by paying a price,

 

So unless you wrongly described your vehicle you should be well within the CRA
