Driver hit me - they have NO insurance - how do i get my car fixed?

HELLO

Recently I had an car accident hit by the other car.

 

I have the dash cam footage as well.

 

the driver told me to deal with her wife (owner of car) and just gave her insurance company and showed me the email of the insurance.

 

However after 2 days of that accident my insurance company told me that that car was not insured.

 

Probably they might have cancelled the insurance before it commenced and they are not picking up my phone.

 

I already filed a complaint against them with police .

 

How can I get my car fixed?

 

Do I have to hire the solicitor or can be done by myself?

 

Can I get advices about it so I can fix my car without dealing with my insurance company.

your insurance co should be doing that.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Thanks for the link.But I am still confused

 

Speak to your Insurers about this.

You have your own Insurance so can get your car repaired.

 

 

The MIB is the organisation that deals with uninsured driver claims and will go after the driver/owner of the other car to reclaim the repair cost of your car as well as any other losses you suffered e.g hire car cost if needed.

 

 

Once the MIB have accepted your claim, your Insurers will be reimbursed and you won't lose no claims on your own policy or it will be reinstated if needed.

 

 

The MIB if necessary will take the driver/owner of car to court to recover any money they have paid out,

 

I should have added that it is possible depending on the accident situation, that the third party driver might dispute they were 100% fault for the accident.

 

 

Quite often a third party faced with owing thousands might decide there were factors that made the other driver partly responsible for an accident.

 

see how this goes. Get the claims started with your own Insurers and MIB.

Thanks for all the suggestions I recieved. Then My first step should be to get my car fixed from my insurance.And What are the chances to get compensation without losing my NCB and excess? I have the video footage of that accident and the pic of the driver(Didnot know his name but I do have the name of the car owner).

Up to you to follow the process and see what happens. No crystal ball. You might face a delay in getting the MIB to deal with it and the claim might be noted as affecting NCB until the Insurers are reimbursed,

 

If you submit all of the information correctly at the start, then hopefully that would help. If you have any questions speak to the MIB.

If you have comprehensive cover you cannot claim for your damages from the MIB, you should claim from your own policy

Thanks. Looks like the MIB no longer involve themselves in going after third parties to recover what Insurers pay out on comprehensive policies.

 

The OP will need to ask their Insurers about recovery against the third party.

This might be an Untraced matter instead then if you don't have the name of the driver.

 

If you were injured as well you might want to consult a solicitor to see what they can do about claiming compensation and repairing your car.
