    • Thank you for that "read me", It's a lot to digest, lots of legal procedure. There was one thing that I was going to mention to you,  but in one of the conversations in that thread it was mentioned that there may be spies on the Forum,  this is something that I've read quite some time ago in a previous thread. What I had in mind was to wait for the thirty days after their reply to my CCA request and then send the unenforceable letter. I was hoping that an absence of signature could be the Silver Bullet but it seems that there are lot of layers to peel on this Onion.  
    • love the extra £1000 charge for confidentialy there BF   Also OP even if they don't offer OOC it doesn't mean your claim isn't good. I had 3 against EVRi that were heard over the last 3 weeks. They sent me emails asking me to discontinue as I wouldn't win. Went infront of a judge and won all 3.    Just remember the law is on your side. The judges will be aware of this.   Where you can its important to try to point out at the hearing the specific part of the contract they breached. I found this was very helpful and the Judge made reference to it when they gave their judgements and it seemed this was pretty important as once you have identified a specific breach the matter turns straight to liability. From there its a case of pointing out the unlawfullness of their insurance and then that should be it.

    • Paragraph 23 – "standard industry practice" – put this in bold type. They are stupid to rely on this and we might as well carry on emphasising how stupid they are. I wonder why they could even have begun to think some kind of compelling argument – "the other boys do it so I do it as well…" Same with paragraph 26   Paragraph 45 – The Defendants have so far been unable to produce any judgements at any level which disagree with the three judgements…  …court, but I would respectfully request…   Just the few amendments above – and I think it's fine. I think you should stick to the format that you are using. This has been used lots of times and has even been applauded by judges for being meticulous and clear. You aren't a professional. Nobody is expecting professional standards and although it's important that you understand exactly what you are doing – you don't really want to come over to the judge that you have done this kind of thing before. As a litigant in person you get a certain licence/leeway from judges and that is helpful to you – especially if you are facing a professional advocate. The way this is laid out is far clearer than the mess that you will get from EVRi. Quite frankly they undermine their own credibility by trying to say that they should win simply because it is "standard industry practice". It wouldn't at all surprise me if EVRi make you a last moment offer of the entire value of your claim partly to avoid judgement and also partly to avoid the embarrassment of having this kind of rubbish exposed in court. If they do happen to do that, then you should make sure that they pay everything. If they suddenly make you an out-of-court offer and this means that they are worried that they are going to lose and so you must make sure that you get every penny – interest, costs – everything you claimed. Finally, if they do make you an out-of-court offer they will try to sign you up to a confidentiality agreement. The answer to that is absolutely – No. It's not part of the claim and if they want to settle then they settle the claim as it stands and don't try add anything on. If they want confidentiality then that will cost an extra £1000. If they don't like it then they can go do the other thing. Once you have made the amendments suggested above – it should be the final version. court,. I don't think we are going to make any more changes. Your next job good to make sure that you are completely familiar with it all. That you understand the arguments. Have you made a court familiarisation visit?
    • just type no need to keep hitting quote... as has already been said, they use their own criteria. if a person is not stated as linked to you on your file then no cant hurt you. not all creditors use every CRA provider, there are only 3 main credit file providers mind, the rest are just 3rd party data sharers. if you already have revolving credit on your file there is no need to apply for anything just 'because' you need to show you can handle money. if you have bank account(s) and a mortgage which you are servicing (paying) then nothing more can improve your score, despite what these 'scam' sites claiml  its all a CON!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

People trapped in huge west London tower block inferno – reports

A 24-story tower block on Latimer Road in west London has been engulfed in a horrifying blaze, with reports saying people have been trapped in flats in the upper stories.

The massive fire has engulfed the Grenfell Tower in North Kensington from the 2nd story to the top floor, the London Fire Brigade has tweeted. It added that at least 40 fire engines and 200 firefighters have been battling the blaze.

So sorry for all the people trapped.How the hell can a fire spread this fast this day and age.Fire alarms etc.

Many people must be wondering. One hundred and 40 flats.500 People roughly.

Flats perhaps around 50 years old.

Reports of fire starting 2-4th floor.Many rumours of why fire started,fridge setting on fire a blast.It will become clear.

Other person saying fire alarm did not work but early days to be sure of anything.

30 taken to hospitals,but how many are trapped in that building.

Many must have been asleep when it started.Early morning-1-2 ish.

Possibly the building could collapse.

London Fire Brigade

North Kensington - tower block fire

Forty fire engines and over 200 firefighters and officers have been called to a tower block fire on the Lancaster West estate in north Kensington this morning.

The Brigade has received multiple calls. The fire is from the second floor to the top floor of the 27 floor building. A cordon is in place around the building and around 30 adjacent flats to the tower block have been evacuated by the police.

just watching this, it is truly horrendous , why is not sprinkler system in place in these awful multi storey places?

 

The place still has flames coming out of it now, first call to fire brigade was at five to one this morning, and now being told probably on the verge of collapse1

It is still on fire and reports say the building was clad in plastic?, people reported trapped inside the building and there is concerns about the stability of the building

 

No fire alarms were heard and yet it recently under went a refurbishment , surely fire doors, and sprinklers, should be fitted and only one fire escape!

Grenfell Action Group said its warnings about safety fell on "deaf ears". In its blog post dated from November 2016, the group warned "only a catastrophic event" would expose the issues residents had with the building - including its one entry and exit and concerns about evacuation procedures.

I understand that 50 + people have now been taken to 5 different hospitals. No information regarding fatalities at the moment, only that there are several.

 

I guess a lot of people would have been in bed at the time it started 12.45am. Apparently no main alarm, only where they were installed in the individual flats. Just one entrance and exit!

 

It is incidents such as this, although thankfully rare - which should tell Jeremy Hunt that closing hospitals, underfunding the NHS and lack of support for Medical staff, is not a good idea !!

In 2013, a year before the renovations began, the residents’ association, Grenfell Action Group, published a 2012 fire risk assessment of the building, which found that fire extinguishers in the basement boiler room, lift motor room and ground floor electrical room were more than 12 months out of test date. Some had “condemned” written on them in large black writing and had not been tested since 2009.

 

“This seems to indicate that monthly occupier inspections are not being carried out,” a health and safety officer said at the time. Concerns about fire safety in the building were relayed to Kensington and Chelsea council.

 

 

A residents’ group also raised concern about the single emergency exit to the building in 2016, warning that if that exit were to become blocked in a fire, people would be trapped inside

From what i heard today, the flats had been renovated with cladding that was not fire retardant and then a decision was made to install gas pipes which went up the stairwell, providing a connection to each flat. There is suspicion that the gas installation was not sealed off properly to stop spread of fire, if say one flat was affected by fire.

 

If this is true then i could see claims against liability insurance running into many tens of millions.

We could do with some help from you.

And, apparently Theresa May's newly appointed Chief of Staff - (who was previously Housing minister before the election when he lost his seat) was supposed to have implemented a review into another Tower fire where 6 people lost their lives - the review appears not to have been released !

 

 

 

King said one recommendation from the all-party parliamentary group was fitting sprinklers to high rise buildings.

“Buildings like the one today over 30 metres, when they are new, would require fire suppression installed. But there are 4,000 older tower blocks in the UK that don’t have sprinklers,” he said.

“There are people who would argue that it’s too costly and there are other measures that could have been done but it’s a fact that people don’t die in sprinkler buildings.”

“A disaster waiting to happen,” is how the architect and fire expert Sam Webb describes hundreds of tower blocks across the UK, after the fire at Grenfell Tower in Kensington that has left at least six people dead. “We are still wrapping post-war high-rise buildings in highly flammable materials and leaving them without sprinkler systems installed, then being surprised when they burn down.”

Webb surveyed hundreds of residential tower blocks across the country in the early 1990s and presented a damning report to the Home Office, which revealed that more than half of the buildings didn’t meet basic fire safety standards. He said: “We discovered a widespread breach of safety, but we were simply told nothing could be done because it would ‘make too many people homeless’.

 

“I really don’t think the building industry understands how fire behaves in buildings and how dangerous it can be. The government’s mania for deregulation means our current safety standards just aren’t good enough.”

it had only one fire escape! the alarms either did not work or was not heard and the fire doors were not working :o

Local people have really come together to help the people affected by all this, I think Brits can be proud of that. And there are funds collecting money to help the victims.

 

It's just horrendous that human error could have made this fire far worse than it needed to be.

One of the residents gave a very informative interview this morning which I listened to on the BBC news. He was concerned at the, as I understand it, gas checking. He saw the type of blue flame connected to this type of installation. Why would the flats need gas installation? Surely the way forward is electric. No report i've seen yet regarding the introduction of gas so reasons for this catastrophe is yet to be discovered.

Apparently there might be around 100 deaths once the flats can all be entered. Many are not accessible at the moment and might not be for a few days.

 

LBC is worth listening to at the moment, as a lot of background information is coming out. There seems to have been alot of denial going on about fire risks and fire service capacity in the area to deal with major events like this. The company that managed the flats threatened people with legal actions, after they voiced concerns about the flat renovations and safety. The concerns were rejected, with responses to deny points made.

 

The UK has a housing crisis and too many people in our big cities are living in substandard homes. The cost of sorting it out, would run into tens of billions, but it will have to be done at some stage.

The Guardian online has a lot of comment about the building, its renovation and how residents' fears were ignored. The management of the building aren't coming out of it well, or the contractors, but nobody is going to want to admit they could be in the wrong, are they?

Looking around there is so much anger building.I will not put any links on for now but seeing how this Government has acted over the last few years makes me feel sick.

How many buildings with defects have been covered up with Cladding this way.I have seen it and I bet many of you have.

Never mind the concrete cancer that lurks in many buildings.

 

The Tower Blocks in my area 70s build or thereabouts were renovated then a few years later blown up.Housing replaced these blocks.

Clearly many are in danger across Great Britain.

Better calm down a touch I feel, many of us are hopping mad today to put it mildly.

So leave for now with Jeremy Corbyn showing how it should be done at a time like this.

Johnson was warned from all sides. The Tories were warned from all sides. They now have the deaths and terrible injuries of innocent people on their hands.

And it seems they don’t care a toss.
