Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am about to take Abbey to court and i want to make sure ive followed all the procedures...Abbey have offered and paid me £940..my claim was for £2,200.
They have told me that they arent paying the rest and i want to take them to court
there used to be a list of actions that you followed...i.e
1. step - order bank statements
2. add up all charges
3. apply for refund of charges using letter template
etc etc...
I want to know how to take shabby to court. ive sent them a lba and the time has run out...not sure if i need to send another letter before taking to court and if i take to court the procedures to do so. I also know you can do the court claim online but want the details
any help will be apprieciated.
I also have another issue with another account where Abbey used the micro fiche argument and ive been waiting for statements since June - what can i do to move this forward
1. DPA request bank charges
2. add them up
3. send prelim letter 14 days
4. send lba letter 14 days
5. claim in court - I RECOMMEND THE N1 form (see links below)
re other account - send 7 day non compliance letter from template library.
