Hi all

 

Debt outstanding since 2013.

Received the initial letters from PRAC & BW Legal through post, offering discount etc.

Received a second letter from BW Legal today threatening a CCJ

 

Was thinking of sending a CCA request but wanted to check with those in the know if it was the correct course of action.

 

Last entry for PayDayUK on credit file (Noddle) shows as satisfied as of 01/01/2017.

I can only assume that this was when the debt was sold.

 

Should I go ahead with the CCA or sit tight?

Have read up whatever posts are active on the forum for BW Legal but the advice differs.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

but atleast you've not moved?

since you took the credit out

so they cant issue it to another address?

 

 

nothing much you can do to prevent a claimform.

and we've not seen one lost here yet...

 

 

and they are offering discounts

Had another two PDL.

 

 

One has been paid, closed and refunded via irresponsible lending claim.

 

 

The other is defaulted (2013) as they wouldn't accept my continuous offers of paying balance off over 10 months by standing order.

They wanted my bank details to help themselves.

 

Have not moved.

Same address.

They offered a discount with me aswell... Sadly they didnt get any of it after i forced their hand and stood up their MD for the shameful person he really is.

They returned it to their client and they havent bothered me since.

 

I think they are chancing their luck with these PDL debts. But im concerned about BW as they seem to have made a substantial sized purchase recently from ICL / TMS / PDUK

Kevin - Just keep an eye out for stuff, If a Claim Form turns up then make sure you come right back here.

Filed an IR claim with the default (QQ) in 2015 but they responded with a list of credit checks that they had done at the time.

If PDUK have marked it as satisfied and this DCA send it back to them, can they make another entry into my credit file or is the issue considered closed?

Yes it does. BW Legal have been known to trip up a lot and i found that when i dealt with them. These are easily defended and even then you have the option of Tomlin when it comes to mediation - NO CCJ ON RECORD! :)

The DCA industry thrives on uncontested claims - Contested ones very rarely if ever go the full distance unless the DCA has ALL the ducks lined up in a row.

 

Remember - DCAs buy a name on a spreadsheet with an amount for much lower than is actually owed - Between 6 & 22%. They usually have nothing on paperwork etc...

We can help with a claim. Just keep an eye out.

 

Remember that letter doesnt say WILL Anywhere either... All Vague Threats,

Received an email. Getting a little nervous now.

 

FINAL REQUEST - This is a serious matter and should not be ignored

 

An arrangement to pay your Balance of £×××× needs to be made within the next 14 days, failing which your account(s) will be considered for Legal Action.

 

The next letter you will receive from us will be a Letter of Claim prior to the issuing of a County Court Claim

Although... I might add... This may be them trying to make a tight case so they can issue a claim form and there not be any loopholes etc...
