Dropped kerb / Vehicular access denied but street is full of it

Hi all,

 

I'm wondering if you guys can help us out with advise.

 

We have applied for a dropped kerb (also called vehicular access) for our house where the front garden has been paved as a drive way.

 

 

When we applied we were under the impression that we would get the permit to create vehicular access based on the fact that 75% of our neighbors already have their kerb dropped.

 

 

To our surprise, the Northamtonshire Highways have denied our dropped kerb citing new regulations that came into effect in 2014.

We were told we could appeal, but that we probably lose this based on the new regulations.

 

Is there a way that we can appeal based on the other dropped kerbs (in legal terms called a precedent) or do we just need to accept the fact that we won't get the kerb lowered?

I can't give advice on this, but why not put a couple of ramps to the kerb and drive in that way? Have you spoken to your Parish Council about this? What do the new regulations state?

The problem is not as much driving onto the kerb as the kerb is not that high. The new regulations say 5m depth by 3m width. We have 6.17m width and 3,9m depth so that's why they are rejecting it. We will try to contact the Parish Council as well.

When you buy a dropped curb you actually purchase the right of way, if you cross the pathway without a dropped curb you are committing an offence (not sure which one but it might be a byelaw) so don't do it.

 

You need to get your local MP involved, include all reasons why you need a dropped curb, dangerous to unload kids in the road, disabled family member, list of all house numbers in the street that have a dropped curb.

 

Get your MP support and get your appeal to the LA in.
