Vodafone default removal

here's my situation.

 

I appiedy for a mortgage and it gets declined.

Head over to credit file and see a default going back to 2015 from Vodafone for £30.

 

I had a sim for an Ipad for my job at the time.

Left job, cancelled DD (stupid I know)

 

 

then 2 months later get emails from debt recovery,

pay instantly then call Vodafone to cancel the contract.

 

 

All fine and dandy (or so I thought) I received no emails or emails chasing the money so assumed all ok.

 

I call VF today to explain that this account was cancelled and I don't feel I owe the money and for them to remove the mark.

"ok sir we will look into it for you and call you back"

 

 

A few hours later I receive a call to say that there is no record of the cancellation and I owe the money,

but if I pay the money they will review the default mark.

 

 

I pay the money,

am placed on hold ready to be transferred to the credit department.

 

 

The handler comes back and advises that they won't remove the default.

I explain that this is crazy, they are ruining me and my family for 6 years over £30.

And that had I had known this was owed I would have paid it instantly (as I did today)

he puts me back on hold for a while.

Again the answer is "no"

 

Do I have a case here or do I need to suck it up and live in financial purgatory for the next 6 years?

Vodafone will not remove the default without a serious battle on your part - they would rather gouge their own eyes out !

Well my battle with VF has ended well for me because I fought tooth and nail to win.

 

I got my negative markers removed and an added bonus of all markers removed. I haven't heard from Very Fudged (VF) FOR SOME MONTHS NOW. 9 months or there abouts before I kick them in to touch for ever and NEVER TO return...

Hi,

Why do you feel this default is unfair? You did cancel the Direct Debit so VF didn't get paid. Have you checked your file recently to ensure that the default is still showing as £30 owing.

While you are considering a response to the above, the OFT debt collection guidance (before the FCA took over) stated that defaults should not be placed for small amounts. I would certainly consider that £30 IS a small amount so while you are fighting VF over this, File a notice of correction against the offending entry (up to 200 words) to explain how this event happened.

 

I would consider sending VF a SAR as before entering a default on a credit file, they should inform you and give you a chance to rectify the error before a default it filed. Your case falls smack in the middle of the farce that VF called their upgrade of the systems which caused thousands of customers massive inconvenience. As the software could not be trusted during this time, it would be incumbent on VF to check fully. They have been known to send messages to a cancelled account and the user would obviously not receive them. Why is it the first you hear of this is from a DCA. VF should have contacted you first. By sending a SAR (with plenty of identity proving documents-copies) the account history may show what (or what didn't) happen.

 

If you haven't instigated the formal complaints system, I would do so.

Hi there, I paid the bill from the cancelled DD that was passed to their agency. I specifically recall calling VF to cancel the account. They are saying they have no note of this cancellation, yet the debt has no increased. Surely if the account was not cancelled the debt would have increased?

Not necessarily...some DCA may try...but they shouldn't as the account is terminated.
