Hi to all community,

 

I am here newbie but before I register with you I read through many other related threads and now I know that Harlands and 'friends' is a [problem] company and they don't have any legal rights.

 

I would like to get help with this just to make sure that I do the right thing.

 

my situation:

 

I decided to join Xercise4Less gym on 31st of May 2016.

I signed for £9.99 11 month's contract membership.

After 4 month's I read very bad reviews about this gym and all other threads related.

 

I decided to cancel my membership through their website twice

but their reply came back negative.

 

After I called Harlands and asked if it's possible to pay all the rest installments and she answered yes you can but it is not possible to cancel membership with them.

 

in the end I agreed to pay all the rest and also I cancelled by myself my DD with them as I know that they keep taking people money after term.

 

Now after 8 month's I received letter from Harlands on 10th of May 2017 saying that:

 

Dear ...

 

Harlands administer the collection of all payments due under your membership agreement with X4L. Your bank have advised us that your April instalment has been returned unpaid 'instruction cancelled'.

 

You have therefore been charged a £ 25.00 administration fee which means you need to pay £ 34.99 to bring your account up to date.

 

Call blah blah blah so we can collect this by Debit/Credit card and reinstate your DD over the telephone. If you wish to pay by another method, you must still phone to discuss your options.

If you do not call us by 23 May 17 you will be charged a further £ 25.00 administration fee. Our tel. line open blah blah blah.

so let me get this right

 

you 4mts in cancelled

but it didn't work?

 

so then you rang them and paid the full contract term till its end? another 6mts of £9.99?] and cancelled again?

 

and now they want more money?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi dx100uk,

 

After i paid 6 month's of 9.99£

i cancelled my DD with them

and now they are saying that i owe them money 25£ adm. fee + 9.99£ and this will re-new DD.

 

I break their Term and Cond.

because i knew they won't cancel my membership without fight anyway as i read so many people complains.

just send the std slick letter by royal mail

OFFER the one £9.99 and not their charges

please don't hit Quote...just type we know what we said earlier..

Hi Meistar and thanks for starting your new thread.

 

1. How many Months have you paid for in total, and how much does this come to.

 

2. When you tried to cancel, did you do this on the gym's online system, but failed.

 

3. Did you give, or have, any specific reasons to cancel when you may have been in a 12 month agreement.

 

Stay OFF the phone from now on and keep all comm'ns in writing only.

Hi Everyone,

 

Okay i'll answer 1 by 1.:)

 

1. according my bank statements they took from me by DD 4 month's 9.99£

+ 19.99£ adm. fee by Harlands

 

 

then 20£ adm. fee by X4L and

 

 

then my last payment just before i cancel my DD by myself 69.93£

which works out 7 month's.

 

In Total Harlands charged me for 11 mont's 109.89 + 19.99£

(which i guess i paid because i signed up new contract.)

but i think it is not fair because also X4L will chrage 20£ on top.

 

In Total X4L chraged me 20£ so called adm. fee because i sign up with them.

 

2. I tried to cancel twice on the gym's online website which already looks creepy as you have to tick all boxes which is term. & cond. for you to sign... other wise it is not possible to proceed.

 

 

My fors reason was just to cancel

but after they declined i tried another time a

nd this time i lied to them that my mother is copletely sick and i have to move back to my country (Latvia) and

 

 

i send them picture of my country location.

 

They said is not good ebough proof and declined my cancellation.

i tried cancel 3rd time last week as my cotract is expired and i am still waitin answer from them.

 

3. I think they are very bad cheaters and one day they will have to pay back all this negativity what they are making from nothing!

 

I will stay of fthe phone.

Just should i change this? I refer to my membership at Xercise 4 Less gym in Milton Keynes which was a 12 month's agreement.

 

And i forgot to change instead of 16.99£ i should write 9.99£ as that could be my last payment without any adm. fee.

a.add up what they have taken from you in total

 

b.add up what you should have paid minus any fees they've taken but + 1 month after DD cancel date.

 

 

if a is greater than b you owe nowt!

1. Harlands.

 

2. The gym.

I refer to my membership at Xercise 4 Less gym in Milton Keynes which was a 12 month's agreement.

 

I cancelled my Direct Debit mandate but realise now that I should have given 30 days notice to cancel my membership. So I am now offering to pay a final month's fee of 9.99£ to cover the notice period. I will not pay you any administration or cancellation fees - these are penalties that are unlawful and unenforceable.
