Morning All,

 

I'm not sure what the best option is here so i thought i would post it on the forums.

 

I purchased a car July 2016, part exchanging my old one with Arnold Clarke. The paperwork and agreement i signed was under a hire purchase basis. Fast forward a few months due to a job change i looked at lowering the monthly payments. This is where all the problems started. I decided to change the car to a lower monthly payment with a local Skoda Garage. They were great and offered to arrange everything and find out my settlement figure on the HP car.

 

When Skoda looked into it and did a HP check on the car it came back as clear of finance, which confused me as I was less than a year into the agreement. I was advised to call the finance company to see what was happening. I called them and they advised that the agreement was a personal loan and not hire purchase, which didn't make sense what so ever.

 

I contacted Arnold Clarke via social media to complaint and to see what was going on, as i then noticed the interest rates/payments each month were different only following the visit to Skoda. Arnold Clark sent me a copy of the agreement through the post. When I looked at what was sent, it was the same as my copy except it was showing personal loan instead of HP. I've attached both documents, the first is my HP agreement which i signed on site, the second is what they sent me. I can confirm that the signatures are bang on identical as if its been "cut and pasted".

 

Can someone advise me what to do here.

Clark at their best---did something similar to me. Told me I had a "Motor Loan" with Santander which turned out to be a personal loan, so couldn't get HP company help fight my corner.

Financial Services Ombudsman office in complete denial of the strict differences between HP & personal loan.

If you suspect the documents have been altered then I can only suggest you consult a lawyer in the first instance. He may suggest if you can prove alterations this may be a police matter.
