    • if i remember rightly, long ago in one of the first drafts of the old proposed gov't overhauls, there was a listing of recommended 'charges' that inc wrong reg = £20. some PPC's implemented such changes in advance. then later as it looked increasing likely the new code was never going to be implemented after it's 1st review and another set of codes was to be debated they all quietly revert back .......... dx

Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all.

I have received a £12 'administration fee' from Harlands.

This occurred when the £16.99 fee direct debit to my gym did not go through as I had no money in the account at the time.

 

 

I am not under any kind of contract with my gym

- I have not agreed to pay them for x months of membership or anything like that.

I can cancel the membership at any time.

 

Here is a copy of the email received from Harlands:

 

Harlands administer the collection of all payments due under your agreement with The Gym Group. Your bank have advised us that your April instalment has been returned unpaid "refer to payer" as there were insufficient funds in the account to pay the amount due.

 

We will therefore debit your account on 28 APR 17 for the total amount of £28.99 made up as follows:

 

Instalment Amount £16.99

Administration Fee £12.00

Total Due £28.99

 

Please note that the submission for this will be made two working days prior to 28 APR 17 and if this date is not convenient, please contact us on the HARLANDS HELPLINE - 0330 998 6382.

 

The telephone lines are open 8.00am to 8.00pm Monday to Friday.

 

Once the submission has been made the debiting of your account cannot be stopped.

 

We trust you find this in order and we look forward to hearing from you soon.

cancel your DD

they are unlawful

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This is very interesting as Harlands have always charged £25 admin fees up until now. Perhaps they've lowered the fees to the same amount that credit cards charge in an attempt to make the admin fee justifiable.

 

If you were on a rolling monthly agreement, you still had to give the gym or Harlands a month's notice. So you should probably have told them you wanted to leave and paid them one final fee before cancelling the DD mandate.

 

Do you have any T&C's from when you joined. If so, please confirm exactly what is said about Harlands admin fee if you fail to pay on time as required.

 

Ignore demands from Harlands/CRS for now.

 

I have to say, paying just £12 plus the missed final fee is a bargain, compared to the months of demands from Harlands/CRS.

Hi slick thank you for welcoming me.

 

The fee wasn't because I have left the gym - I have not and don't plan to. The fee was incurred as the usual monthly direct debit didn't go through as my bank account had no money in it. It does now, and they want to take out what I owe them plus the admin fee. THere is no way I am paying that fee if there is anyway not to. As I am new here I don't know the normal procedure for this kind of thing. Any ideas?

Hi Seal and sorry I missed the crux of your post. I was in a hurry. :oops:

 

You are usually either in a 6 or 12 month agreement; or a rolling monthly agreement.

 

If it's the latter, you normally DO have to pay 1 final fee after giving notice to cancel - and then you can cancel the DD mandate. Please see the guide here - http://www.consumeractiongroup.co.uk/forum/showthread.php?452671-Cancelling-your-Gym-Agreement-Get-it-right-!(1-Viewing)-nbsp

 

Turning more specifically to your case, we always tell folk to cancel the DD immediately if Harlands threaten to take an admin fee on top of the unpaid fee. Cancel the DD now.

 

You can then write to the gym offering to pay the missed fee but NOT Harlands admin fee.

 

Please confirm :-

 

1. What gym is this about.

 

2. Have you had any T&C's given to you; or maybe you agreed to them on a gym's computer system; or on the web. If so, please check and see what is said about any admin fee Harlands may charge.

My gym is called 'the gym'. Link here: www[DOT]thegymgroup[DOT]com. Is there a legal template letter I should send my gym? I don't remember there being a contract of any kind. In fact if you follow the link I've provvided their main page explicitly states NO CONTRACT

Hi Seal,

 

Aha, now it's becoming clearer !

 

I've had a skim through the gym's FAQ's and can't see mention of a failed DD pay't but I suspect Harlands like to charge a (smaller than normal) fee when A DD fails.

 

If you want to stay a member, call the gym as per their FAQ's to discuss it - How can I make a payment/reinstate my membership? - it gives a number to call.

 

Maybe tell the gym you want to remain a member but you had no idea Harlands would try to charge a PENALTY fee for the failed DD.

 

If they insist you have to deal with Harlands direct, or insist you have to pay the penalty, you may have no option but to let the m/ship lapse and cancel the DD.

 

Let us know and we'll take it from there. There's no legal template letter to send. In fact, quite often the best action is to do nothing and ignore Harlands demands.
