Can anyone tell me if this is normal for IF: After 40 days and no response to my S.A.R - (Subject access request) and the reminder, I sent an lba giving 7 days. Got a letter back today which says:
Thank you for your request to access the information we hold about you, which is your right under the Data Protection Act 1998. Please note this is not classed as personal information therefore we are not required to provide this as part of the DSAR. I have however detailed below a summary of any charges applied to your account since the date of appliaction. There is no charge for this service on this occasion.
Firstly, I am sure that Ms Sarah Jane McGowan, customer relations consultant, is not correct. However, is the list of charges sufficient for the purpose or should I insist on the full statements, bearing in mind I want to get claiming without delay?
Second, despite what she said, they cashed my £10 cheque as soon as they got my original SAR.
Third, there are some £10 charges for 'arrears letter'. Can I claim for these?
I think Intelligent Finance are continuing to show their incompetence. They sent me full copies of statements for the first 4 years I held my accounts with them, and then for the last 12 months have sent a list of charges.
I think if they have not sent you the full statements then you should request a refund of your £10, or at least include this in any claim against them.
I would claim the £10 for arrears letters as well. Like all the other charges they would need to show a judge in court what costs the £10 is made up and I doubt they will do that
Thanks. I have written back and told them what they said was nonsense and why did they cash my cheque if there was no charge. I have given them 7 more days to give the correct information before going to court, which extends my lba by three days in effect. I will press ahead with the claim for charges in the meantime. I was thinking the same as you regarding the £10 charges. They will still have to justify them.
