    • Well tbh that’s good news and something she can find out for herself.  She has no intention if peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now- post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!  Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.  Somehow rekeyed as normal when I was called with the results.  A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

    • I think you have the supremacy of contract as it allows you to park in designated areas. I would argue that there being parking enforcement there clearly means its to be used as parking and as such you can use it under your lease. Only need to worry if they ever follow through with a letter of claim and a claimform though

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

UK Prime Minister Theresa May has announced plans to call a snap general election on 8 June.

She said Britain needed certainty, stability and strong leadership following the EU referendum.

Explaining the decision, Mrs May said: "The country is coming together but Westminster is not."

There will be a Commons vote on the proposed election on Wednesday - Labour have said they will vote with the government.

The prime minister needs Parliament's backing to hold a vote before the next scheduled date of 2020.

Explaining her change of heart on an early election, Mrs May said: "I have concluded the only way to guarantee certainty and security for years ahead is to hold this election."

The Tories can raise millions in a short space of time. Labour are in debt and need Trade Union money to fight an election, which they might not get. Lib Dems are also not in a finanicial position for an election.

Corbyn is mad to support an early election that his party is not equipped to fight.

We could do with some help from you.

They were in debt, but have had good income over recent years, so might not be the case. The last election cost them £48 mllion.

IMHO, I think she was right to call an early election and I am just surprised it has taken her so long.

She is constantly being told she doesn't have a personal mandate - she will now either get it or not. Perhaps it will make those in her own party who are causing her grief either put up or shut up.

. "what another one?"

quite. :)

and May told sturgeon not so long go that it was not the time, with brexit etc, for another 'vote' ie scots independence ref...

sturgeon saying that the election is 'miscalculated'

cf. though that sturgeon did put forward before that the pretender didn't have the mandate...

What happens when the Tories lose their majority ? Not very likely looking at polls, but how many would trust the Tories with a large majority e.g hard brexit with no negotiation on article 50 terms, no EU trade deal in sight, removal of many rights e.g Human rights, workers rights.

During the election campaign Theresa May is going to have to tell voters her full plans and they may not like them. Jeremy Corbyn seems ill prepared to offer an alternative.

This is going to be interesting as will those who could have voted in the EU Ref but didn't and blamed the people who did:madgrin: will vote for a party, or could it be possible, an independent who wants to reverse/challenge the EU ref outcome. A twist in the tale.

Do you mean anyone but the Labour party snowdragon, or do you mean anyone but the Corbynistas?

If the former, why do you think that the Conservatives, who are the prime movers in creating what I think you probably mean by our changed country, are any better?

If i remember Snowdragon does not like Labour due to things that happened when they were in power that affected their family. Personal experience is always a major factor behind voting decisions.

Unfortunately, there is no alternative to political democracy for a decent society. Otherwise you have Russia, North Korea, Saudi Arabia to name a few.

I would like proportional representation so every vote counts and there would be more choice.

Of course she wont allow herself to be directly asked difficult questions

Very mini-Maggie May

at least Maggie would stand up to anyone toe to toe.

What mess was that snowdragon?

I do recall there being lots of news reports about the 'coffers being empty' when the Tories took over.

If that is one of the main reasons snowdragon, then look here

https://en.wikipedia.org/wiki/United_Kingdom_national_debt

525px-UK_Debt_to_GDP_ratio.png

If Labour had borrowed the amount the Tories have, but with Labours same expenditure, we would have been cash wealthy and just built the nuclear reactors and tidal power lagoons.

"The British Government debt is rising due to a gap between revenue and expenditure. Total government revenue in the fiscal year 2015/16 was projected to be £673 billion, whereas total expenditure was estimated at £742 billion. Therefore, the total deficit was £69 billion. This represented a rate of borrowing of a little over £1.3 billion per week."

Interesting that Brexiters and Tories are calling into question Tim Fallons LGBT views.

Now Fallon apparently is an Evangelical Christian, and refused to answer when questioned whether he considered gay sex 'a sin', refusing, he said, to get involved in theological questions but that the Christian view was that we are ALL sinners.

Now whatever Fallons personal beliefs may be, the record shows he unarguably actions his votes in a liberal and progressive way pro LGBT rights,

and if he has personal religious based opinion, they quite correctly remain personal opinion.

Strange though that in promoting May's apparently newfound LGBT 'friendliness', these spinners completely fail to highlight Fallons positive support of LGBT rights,

and also fail to highlight MAYs demonstrated and actioned OPPOSITION to LGBT rights

http://www.bbc.co.uk/newsbeat/article/36683521/is-theresa-may-the-right-conservative-leader-for-gay-people

"Mrs May has previously voted against reducing the age of consent for gay people, the repeal of Section 28 and civil partnership."

as has Liam Fox *Liam Fox has voted against every "gay rights" bill during his time in Parliament. It's said he resigned from his student union after a decision to allow an LGBT group to join.

and Stephen Crabb (who apparently believes it can be 'cured' and "I don't regret any vote I've taken," he says of his views on gay rights.)

Now based on one + vote from May (now its politically expedient some might say) May and the Tories are touted as a LGBT champions

LOL

They are certainly far far better at spinning lies than anyone else
