My wife recently received a PCN from a day I had her car for the day.

 

I went into Costa at Lydiard Fields Swindon and the car was photographed on the entry and exit.

 

The PCN states I exceded the allowed parking period.

 

I set my alarm to allow me time to get back to the car before the 1 hour maximum,

but was asked by my PA as I was leaving to bring her a coffee back.

 

I turned round and joined the drive through queue and that took over the 1 hour although the car was not parked but in the take away queue.

 

Any plan of action to fight this PCN?

Others more knowledgeable than me will be on in the morning, but (a) there is supposed to be a grace period of 10 minutes so no overstay happened and (b) being in a drive-through queue is not parking! You won't pay a penny.

 

Do you still have the receipt for the coffee? Useful but not essential.

theres a grace period of at least 10 minutes AFTER the allowed stay as elapsed. Also as advised, being in a drive thru queue is not parking. But the PPC doesnt care.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I would suspect the area has a far long free parking time

and that the area is shared and Britannia Parking are not the land owners nor have a contract with the land owners to issue PCN's on their behalf

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I too have received one for the first time in a few years of visiting the same costa, and on many occasions have overstayed the time limit.

Is it fair for them to suddenly start enforcing the rules despite not having done so for such a long time (I'm also talking several years), and is there grounds for appeal as a result?

If there was the option I would pay to stay longer as it is a good place to sit and get work done, which often does mean overstaying the time limit, however as there isn't the option of paying I find it quite unfair that they are suddenly trying to fine people. Any thoughts?
