Please can someone give me some advice about County Court Bailiffs and what powers they have?

 

It is a bit of a saga which has ended up with having to borrow money from a pay day lender, not being able to keep up the repayments, interest spiralling and a CCJ issued.

 

I offered payment which I could afford to the Court to stop the CCJ but it was ignored.

 

Contacted the company before it went to Court and offered payment and asked for original papers this was ignored.

 

Got home today to find a letter from a County Court Bailiff in the post.

 

Bizarrely, the letter said he visited my home,

but the envelope was clearly stamped and delivered by my postman.

 

He is demanding attendance at the County Court Bailiff Office,

is this obligatory or can it all be done by email/post?

If he does come back, does he have a right of entry?

So have you been given notice to attend a county court to explain why you have not paid ? If so, you must attend on the date requested and email will not be enough.

 

You could phone this bailiff and explain to them. You might be able to set up a payment arrangement and the need to visit the court is removed.

 

If the claimant holding the CCJ has applied for your attendence at the court and you failed to do so or agree payment, you could be held in contempt of the court, which is very serious.

 

Can you explain why you did not properly defend this claim and have ended up with a judgement against you ? What is the story ?

Can you explain how your payment offer was made to the court? For instance, did you respond to the summons?.Did you attend the hearing?

 

County Court bailiffs are much easier to deal with than private sector bailiffs. If you cannot afford to pay a CCJ then the correct course of action, is to submit an N245 application (to vary a court order) to the County Court together with the necessary payment or exemption (see EX160).

who was the claimant

and what was the debt all about?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
