    • Hi All,  I have tried to use my own words as much as possible, any better suggestions are welcome.  I have been sleepless and hence i can't really think of alternative words, will definitely give it another go if you have points that i may have left out? Worry
    • Thanks all for all your input. I have decided to follow this all the way. So far, I have not replied to Alliance Parking's original NTK letter. The time-period for the reduced amount has now finished, and the time to appeal (21 days from the date of letter) will finish on 25th Apr. No further comms received from Alliance Parking. Could you please guide me, for my readiness, on what happens next? Am I going to start receiving letters from Alliance Parking > Debt Collector letters > Letter of Claim? Who sends me the Letter of Claim - Alliance Parking / Debt Collectors / Solicitors / court? How many weeks / months from now is this likely to be? Once Alliance Parking passes the debt off to the Debt Collectors, is there a risk of anyone turning up at the door? Do I need to reply to any other letters from either the parking company, debt collectors, or solicitors? Many thanks in advance.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My 16 year old niece stole a £5.00 purse from Primark. She had no intention to steal it she hung it over her wrist whilst shopping and forgot it was there. She was stopped by security after leaving the store. She admitted she had forgotten to pay. She was taken into a back office and questioned by 2 male security officers. One left the room and the other one searched her bags. She was told that if she admitted she had stolen the item they would let her go. But if not they would call the police and she would be prosecuted and have a criminal record which would follow her everywhere. My niece was extremely frightened and admitted the theft. They phoned her grandmother to ask permission to let her go. As she was leaving they said they would write to her. She then received a letter from RLP claiming almost £190.00.

I wrote to primark and the security company saying they had no right to interview my niece without an adult nor a female present. I also pointed out that they could not search her bags.

Primark and lodge security basically ignore my letters and RLP are still claiming the money. As my niece is only 16 I belive they acted unlawfully. I also believe that they are unable to bring a civil action against a 16 year old. The amount they claim is also disproportionate.

I am now at a loss how to procede. To speak to a lawyer is out of my niece's price range. But I do not think that this company should be allowed to act like this. They are acting on people's fear.

Can anybody offer any advice on my next step.

RLP cant/wont take civil action against any age...whether your 16 or 96..do not engage with RLP.

Long answer.

 

RLP can do nothing. They may claim that they will wait until she is 18 and then take action. The ONLY action RLP can take is to write letters, nothing more. Only Primark can take action but the don't. It costs them far more to take action that they could ever hope to reclaim so they don't bother and leave it to RLP to do the dirty work.

 

It has been known for RLP to write to the parent/guardian of an under 18 which is in my opinion, just another scare tactic.

 

As your niece was under 18, there should have been an appropriate adult present before any action in the holding room.

 

In my opinion, ignore RLP and any tame debt collector who may come chasing. They can do nothing.PERIOD!

 

On to Primarni :!: If you feel this is worth enough to take on, write a formal complaint and send it to their head office. They may try and pass the responsibility on to the security company they use but that is a get out. Primark are ultimately responsible for the actions of their agents. They should also be brought to book over their assumption that everyone is a shoplifter and people don't make mistakes. Shameful

My research had led me to believe everything you have confirmed. I have complained to Primark and as you said they passed the matter into the security company. I raised my points regarding the legality of their actions and they ignored my letter.

Is it best to just ignore the demands from RLP? Somebody suggested sending a cease and desist letter claiming they were harassing my niece.
