      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After several year's absence I'm back

 

 

as agreeing to a PPI claims company searching

they discovered several accounts of different persuasions which they said had PPI on it!!!!

 

 

I certainly don't remember agreeing to this by banks etc at the time

 

 

but my problem is that 2 of these accounts were mortgages and as the last one was paid off in full back in 2012

 

 

can I ask for my money back without any account numbers?

 

Can someone point me to the correct information section as I had problems just locating the letters section to reclaim late payment fees - must be my age................ Thanks in advance

i wouldnt be giving them the chance to try

write and cacel any notional contract that they think might exist.

 

we've also seen that when you do get PPI back

it turns out that the CMC put a marker with the bank sayin they are joint clients in any claim

and the banks then write to them as well if they cough up.

wow, thanks for that and doing some reading today I will be sending SAR to whatever companies possible owe me money. Then read up on just what I am going to claim with interest. Best to assume this is going to take a few months even when information is supplied I suppose.

Blimey talk about not getting on with this. Sent letter cancelling any contract with that company but I can't find the template letter to send to the companies to reclaim my PPI. Can someone point me in the right direction please.

No, bit dim today and I couldn't find the actual SAR letter. Somehow I hit on it and now sending at least 3 letters so finding the spreadsheets will probably be a difficulty so perhaps I should spend time just looking around the website. Thanks for the response.

- how do I identify the PPI payments?

 

 

My application shows they ticked 'yes' for PPI but I only signed the application form and they filled it in so is my defence that it was not explained properly to me.

 

 

It also shows I cancelled the PPI and thety started it again on the same day 18 months later.

 

In the week I had a phone call from the PPI reclaim company and they said they didn't receive my manual letter cancelling my contract and was I sure I wanted to cancel which I have now done verbally. Should I send manual letter again just to be safe.

Oh struth - I'm being all stupid again as I can't find the template letters to send prelim letter

- can anyone give me a link.

 

 

Are they really going to cough up as charges were under £100 and with 8% interest my claim is in excess of £3000

- such a long time ago the PPI was added to my account.

 

 

My account was never in credit till after the PPI was ended so just used the simple spreadsheet no 2

Purservance is a wonderful thing - I just use the credit/store card letter right as there dosen't seem to be one for PPI. With end date of 2003 not claiming much then. thanks for putting me right.
