    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All.

 

I wonder if anyone has encountered a similar situation.

 

I booked some tickets for flights with Arik airlines on the 9th Feb.

 

Arik have since suspended all flights from the UK since they are in financial trouble.

 

After contacting travel trolley numerous times,

I have been told that i cannot get a refund until they hear back from Arik airlines.

 

So far, all their queries to Arik have gone unattended (so they say).

I booked these tickets with a visa debit card.

 

Where do i stand in terms of a refund?

 

The thing about this all is that i need the money back so i can re book those tickets with another airline, and i am due to travel in April.

 

What is the best way around this??

Put in a written claim against your credit card company immediately.

These were paid for via Debit card... So they will need to do a Chargeback

Centos... Whos the bank plz?

 

Santander. They are not the easiest to deal with when it comes to this sort of thing...They seem to forget it is my money...

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hello all.

 

I have an update here.

 

After a call to my bank, and some form filling,

 

the final response i have got is this

 

"We can't refund your claim.

To resolve this, you need to contact the retailer directly.

We're sorry for the inconvenience".

 

I shouldn't have expected anything more from Santander.

 

Is there anything else i can try before going to the Ombudsman as i think even they might reject this claim.

No Travel Insurance covering Airline failing ?

 

If not, i think you will have to book alternative flights and then try to claim back later through the airlines administrators, if appointed.

 

Have you checked the relevant foreign governments aviation website regarding Arik. Normally, there are international obligations where airlines fail.

Arik have not quite failed yet.

For now they have suspended international flights but I'm not sure exactly how long for this is supposed to be.

 

 

No insurance but the agent says they are abta and atol registered, but I doubt this will help me.

 

 

I have already booked the new tickets.

 

 

I had to as this is a journey I must make on the given dates.

I don't think they have resumed international flights.

Does anyone else have any suggestions how I can get a refund? My bank has already declined. I want to go to the ombudsman as a last resort only. Travel trolley will carry on telling me I need to contact Arik air in Nigeria, but this is not a realistic option...

Phone ABTA about this. If the tickets were cancelled because of an industrial dispute at the airline, given that the flights have not happened yet, i suspect Travel Trolley have your money.

Update:

 

Still fighting with Traveltrolley to get my refund.

 

I now have a case raised with ABTA, but it is going very slowly.

We wait and see.

 

I have already done the trip via Virgin,

but whilst on my trip i enquired with arik airlines customer service locally.

 

They told me Travel Trolley have the money.

We will see.

 

The way it is looking, it looks as if ABTA will not be able to help.

 

Update to follow as soon as i get one.

I registered just to let you I went through the same thing with Arik air.

I paid with my Barclays connect Visa card, which isn't a credit card.

 

I paid via opodo though, just contacted my bank and they did a charge back in February and gave back the money straight away as they investigated.

 

One month later, wrote to me that they've found in my favour.

This us a clear case of not receiving service you paid for.

 

 

Arik is no longer flying to or from London.

I suggest to contact Santander and complain, they should've easily dealt with this, this is classic chargeback surely.

 

Let them know, traveltrolley has had more than 30days to deal with this and still not.

Don't give up, this is so unfair.
