Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi, I haven't posted on here before but I'm hoping someone can help me. I have a Natwest step account, because they would'nt give me a proper one despite me having a mortgage etc, I was made redundant in dec 05 and have consequently been a bit short of money; my mortgage has been paid every month but I was a few pounds short of my car ins. dd in feb so they refused it and charged me £38 [grr!] it was re-presented a few days later and paid as i had put money in, then the same thing happened in march, I was again charged £38, my partner had transferred enough money to cover the dd on the day but it was still refused and i was charged so i resigned to paying in more to cover it but then received a letter from my car ins asking me to ring them, they told methat natwest had cancelled this dd altogether, I phoned natwest and they [rather patronisingly] said that as this dd had been returned twice in 2 months they had no choice but to cancel it [as well as charging through the nose!] Are they allowed to do this? they did'nt even inform me by letter about the charges, or the cancellation of the dd.?
I don't know if they are allowed to do it - but they do it with great regularity. They cancelled my DD for my life cover linked to my mortgage and, yet again, didn't inform me.
One thing with Natwest is they can't even claim to incur costs in sending a letter - I haven't recieved one for years!
Same here I rarely get letters from them. Best thing to do is follow the guide asking for your charges back, when you ask are they allowed to do this, well they do but they are also giving people the money back so they know they are in the wrong. For a smaller amount I would ring and ask for it back, if you get a no or only part of it offered then start a claim against them using the step by step guide.
Thanks for the advice cheddar and tarka, I will try to claim charges back after reading about it, there have been more charges than this too. What I was really annoyed about though is how they decided to cancel my dd instruction to my car insurers altogether without my consent, surely this is illegal?
