Smart Parking ANPR PCN for 10mins overstay

Hello everyone! This is my first time and I am happy to join this community of consumers.

 

I have a parking 'fine' by Smart Parking in a retail parking at around 22:5hrs for 10-11min, with a 3hrs free parking but must obtain a ticket.

 

Now it is late at night and the two ticket machines are situated together at one end of the parking which is 50m from where I am parked and as a current blue badge holder , I have difficulty in walking that distance as the place I was going to was less than 50m.

 

Also as the retail park closes at 20;00hrs the car park is virtually empty.

 

Hence, I appealed the PCN but was rejected by a response to a car and details that are not mine,

so now I want to put an appeal to POPLA, what points are my strongest so I can get this PCN cancelled?

Hi and welcome to CAG.

 

What type of ticket was this? If it came in the post then they used ANPR to photograph the car on entry/exit. If a ticket was placed on the car that is different.

The ticket was posted, it was an ANPR. I have appealed to the company via their website and was rejected now I want to appeal to POPLA.

Can you confirm that this was an overstay totalling 3 hours and 10-11 minutes?

 

In the BPA code of practice a car displaying a blue badge should not be ticketed however that doesn't work for ANPR obviously so in any appeal, mention should be made of this so that the parking company knows.

If possible, can you get pictures of the signage on the site.

 

While we do not have any data for this year as yet, Smart Parking took no-one to court last year so even if POPLA reject your appeal, Smart will have to take action via the county court as this is NOT a fine. It is a Parking Charge. Totally different

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

can you post up what you got from Smart?

 

 

If may be worth cmplainting to the DVLA or to the BPA

(if smart are still members, they seem to fail to tell people about this on their signs, a breach of their membership and the law)

 

What exactly did you say in your appeal to Smart,

that will help us determine what to concentrate on
