Collect Services letter warning bailiff, Need help

I received a letter today from Collect Services regarding a penalty charge notice on the 16 May 2016.

 

The vehicle was registered at a previous address where the person there an ex used my car and received a previous penalty charge notice for the car.

 

 

I did not receive this as I spilt up with him and he did not give me any letters,

it was not until later that bailiffs turned up at his property that he told me.

 

Therefore I was scared to give DVLA my current address as I did not want bailiffs at my house.

I now received a new PCN which i think was due to sitting in residental parking ,

 

 

It is a letter from Ealing council in London stating that a PCN was sent to the previous house in concern of legislation,

this is usually the address to which the vehicle was registered with the DVLA at the time of contravention occurred unless an alternative address had been provided.

 

 

As the sum due has not been paid a warrant has been issued to remove goods if not paid in full. IT STATED.

 

I have a learning disability, and anxiety. I will write a letter to state I am self employed as I trying to legally start.

 

Any help

 

Can I have this sent aside,

put back to court for the original charge

and what about my ex driving for the first contravention,

I cannot prove this??

urm.. if they find out what you've done [DVLA] theres a £1000 fine for not updating your car/driving licence address too...

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Okay, my driving licence is updated to my address. My ex wanted me to register the car at his due to him using the car. I left due to domestic violence and he refused to give me my letters and some of my belongings. I had to instruct somone to go to the house to try and collect the letters, he still refused.

You say that you have received a letter from Collect Services and also from Ealing Council. Are both these letters in relation to the same penalty charge Notice?

You need to also update your logbook (V5C) to your current address as well.

You say that you have received a letter from Collect Services and also from Ealing Council. Are both these letters in relation to the same penalty charge Notice?

 

If you could respond to the above query, that would greatly assist as my first thought is that you may well have grounds to file an Out of Time witness statement with the Traffic Enforcement Centre. All bailiff enforcement will then be on hold for a short period of time.

Apologies was doing DIY for my lil one.

Hi I have not received a letter from Ealing council at all as this went to the previous address of my ex. I have now received a letter from Collect services stating that they will start enforcement.

 

No they are not related. Both PCN's are separate.

Yes the letter from Collect services has come to my present address.

 

I still have the vehicle.

 

The previous ticket was from Brent council, Bailiffs have been instructed to come to the previous address.

Thank you Heather for the additional information. I did not initially want to suggest that you submit and Out of Time witness statement as I was aware for your earlier post that you did not want a bailiff company to know your current address. That is not longer of concern as you have stated that the letter from Collect Service has come to your current address.

 

An Out of Time witness statement is the correct procedure. It may assist you to first read the comments on another thread from a few days ago.

PS: You mention that you have learning difficulties. Are you in receipt of any benefits or are you employed?

Hi

i was able to apply to Northampton and have my PCN sent back to the council.

 

I want to appeal as the photograph says I am turning right in a no right zone.

 

The picture is unclear to see any signals of no right turns,

 

also the pics state that I am stationary but not actually turning right.

 

I am awaiting the video evidence, but I feel I want to appeal.

 

Any thoughts??

With the acceptance of your Out of Time witness statement, you are now in a potion of being able to 'appeal' the contravention. This part of the forum though deals with bailiff enforcement. I would suggest that you ask a question in the local authority parking section of the forum.
