My friend visited the University Health Centre in Huddersfield HD1 3AL for a pre-booked medical appointment.

As the main car parking area at the front was full she parked along the side of the Health Centre.

On returning to her car after the appointment she discovered a PCN left by UKCPS stating she had no valid permit.

She couldn't see any signs regarding parking restrictions and there were other people parking in the same place and going into the Health Centre. I have been on Google maps and the area does have several parking areas; not all with clear boundaries!

Please advise if this can be fought?

2 things,

never appeal a ticket placed on the car windscreen,

doing so removes almost all of the safeguards in law provided by the POFA.

Secondly, the ticket says parking without a permit.

This menas that it is a prohibited act so you cant be sued by a third party for a contractual condition that cannot exist nor as a breach of that non-existent contract.

They need to wait and see if UKPCS send out a NTK.

It will be a miracle if they do becasue they are currently banned from accessing the DVLA database but that ban ends soon.

This raises a question as to whether one should appeal as KEEPER and then they may well forget to send out the NTK but try and extract money in the confusion ( and lack of accessing the DVLA) and one can then tell them where to stick it at a later date after the time has passed for lawfully obtaining those details.

The problem with this argument is that you have to give out your name and address to avoid them obtaining the details.

As for the legitimacy of the demand

- it will be rubbish but we would like to see the signage and a nice picture of where the car was parked from different angles, including any evidence of boundaries on the properties.

So, my advice?

Keep the ticket safe and wait for a letter through the post,

which may arrive between 29 and 56 days after the date of the event.

We will need to know exactly when it arrived as well.

There may be a bit of further digging required,

the local council will give you the details of the boundaries of the various plots of land,

they need the info for sending out rates bills.

The Valuations Agency also have such info for business rates purposes.

I have found them helpful when you can clearly identify exactly what building the vehicle was parked outside.

Once that is known it is fairly simple to find out if they have signed up UKPCS to " manage" their parking or not.

UKPCS have a habit of telling lies so only challenge them when you have some other evidence tucked away.
