Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Firstly thank you to all the people who run and contribute to this site it has got me to the stage of an offer of half from Barclays in just a few weeks. My first reaction was to accept as we are emigrating in January and £750 will help a lot. However, I want to go for the whole amount and according to the guide I would need to send the letter before action but it doesn't seem relevant - do I just change it to say no to the offer and if I then get refused more and have to take it to court can I just backtrack and accept the £750? I hope I have put this in the right place and if I haven't I apologise, good luck to all.
You write and accept the offer only a apart payment of the amount requested and you will continue your claim for the remaining amount. Adjust thier offer as you need to make sure you scribble out accepted in Full and final payment.
If the time drags on you can send a letter advising you are willing to now accept the amount in full and final settlement but hold out if you can.
Hope you get a payout in time, dont let them know you are going they will definately hold back.
