      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A debt collection firm has agreed to write-off £414m worth of claims after the Financial Conduct Authority (FCA) found systematic failures in the company's systems and controls.

 

Motormile Finance, which also trades as MMF, will write off debts that it had purchased from third parties owed by more than 500,000 customers.

 

 

 

Motormile, which also trades as MMF, MMF Debt Purchase and MMF UK, describes itself as “one of the leading debt purchase companies in the UK,” and specialises in buying up old payday loans and other debts, and then attempting to recover this money.

 

According to consumer website forums, the company has bought payday loans from a number of lenders including Cash Genie, Peachy, Mr Lender, Lending Stream, Swift Sterling, WageDayAdvance and PoundsTillPayday.co.uk. It is also understood to have bought car finance loans.

 

The FCA said that after buying debts, the company failed to carry out the necessary “due diligence” to make sure the sums of money that were said to be owed were correct. It added: “This in turn led to unfair and unsuitable customer contact for recovery of those sums.”

 

A redress programme has now been set up, affecting more than 500,000 people. The vast majority – who typically received a letter or email saying that the debt had been passed to Motormile – will see their debts written off. Typically the debt will run into several hundred pounds per person.

 

In cases where the affected customers had started making payments to Motormile, it will be repaid to them. A total of £154,000 is being repaid to 2,148 people, which averages about £72 per person.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

So, their appalling behaviour has come and bitten them..HARD. It couldn't happen to a nicer (cough!) company.

 

What's the betting they screw this up as well?

Dam recently finished repaying one debt to this company and still Two smaller debts on they file that was going to start repaying... will hold off now, wonder if I will get refund of debt repaid ?

A good result - although a hell of a lot more should be returned to the customers affected...

 

Hopefully they will have learnt a lesson but I very much doubt it - wouldn't be surprised if they try to claim that a lot of the so called customers were untraceable.

just read this post.

 

i have had 2 MMF accounts since 2011 - one for a speedloan account and another for National cash advance which i believe have stopped trading in the uk.

 

are these likely to be written off?

 

i already had my NCA account merged with 2 pdl debts which i claimed as SB and they wrote them off.

 

i currently pay £1 a month on both debts

The latest on this is that affected customers will be contacted by end of February 2017 up to now this date hasn't changed,

 

 

no one I know has being contacted as yet, including myself.

 

 

I keep looking out for follow up articles but as yet found nothing.

 

 

The following message still remains on their website:

 

Customers do not need to take any action as the identified customer accounts have been placed in quarantine for several months throughout the process.

 

 

MMF will contact affected customers by email in the coming weeks or they will receive a letter by post.

 

 

The company plans to complete the redress scheme by February 2017

Watching this with interest as I have just discovered a default placed on my CRF by motormile in 2016 for an old cash genie loan which defaulted in 2012!

 

 

I am livid to say the least as working hard to clean my file up.

 

Hoping it will be written off or removed as part of the redress

otherwise I'll be bombarding them with letters and complaints till its removed.

 

Would be grateful if anyone has an update on this or if indeed anyone has had any redress from them yet....

Anyone had any contact from Motormile, as the redress period has passed,

 

 

spoken to others who have accounts with this company and nothing heard via them,

 

 

thought would ask on here for any recent up dates ?

 

 

Keep checking my e mails even the junk section most days but nothing..

 

 

. Really though people would be getting contacted by now....
