    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Once it becomes clearer what Brexit would mean for most ordinary people, i think you will see massive protests in cites across the UK and government will be forced to think again.

 

I think you are mistaken unc,

Despite all the rhetoric about 'the people have spoken', they aren't interested in what the people say, ONLY how they choose to interpret it.

 

Article 50 will be triggered, at which stage there are far too many agreements needed to undo that.

 

Then the 'deal' with the EU will be made just like Camerons 'renegotiation':

Nothing much but a few reciprocals for most, and tied in with that lots of special treatment for the Financiers etc.

and its then accept it all or get nothing, just like Camerons 'EU renegotiation'.

 

and as its all the lobbyists paymasters who will be the beneficiaries, the minor bits will be oversold and the benefits for the boys undersold - just like with Camerons 'renegotiation'.

 

So the deal will be be benefits for the boys - or nothing.

What will almost certainly happen is that May will do her utmost to delay any Scot or Irish referendums in the hope that the EU is going to be hit by more countries leaving - or at least look like they might, so as to sway public opinion with risk that they would be leaving the UK into a collapsing block.

 

Might work too.

The UK leaving instead of leading change in the EU is a severe blow.

 

If the UK had driven positive and constructive change while a member instead of looking after the few, things could have been very different. If we do end up not leaving, our politicians approach and goals MUST be very different

We don't want a 2nd referendum (well I don't, neither does anyone I know) Nicola Sturgeon can spout some garbage, she'll talk herself out of a job shortly.

 

 

A lot of Scots I know don't want one either. They just want her to sort out the issues she promised to sort out.. eg Health and Education.

Its also interesting to see articles regarding Scotlands finances and the Sturgeon has overspent on Schools and Hospitals ..

 

What a darned disgrace when that money could have gone toward the English parliaments Trillions in supporting the bankers.

Particularly when a number of those banks are considering moving to Edinburgh if Scotland gets an EU deal - as they may once the EU are able to offer one ....

Think the articles pretty spot on HB, I never hear anyone talking about a 2nd referendum bar Nicola Sturgeon.

 

 

How much do you think the Scottish independence vote was affected by the selling point that an independent Scotland would NOT be a part of the EU, and would have to spend years applying with NO certainty of membership?

 

Because NOW there is a measure of certainty that they will be dragged out the EU if they remain part of the UK

No other option is certain.

 

Of course if the UK does not leave the EU, Sturgeon is rather scuppered.

Brexit will cause the care crisis to become worse, because any visa system for the workforce number required will make it worse. After Brexit EU care workers will be part of any visa system, therefore making it more difficult to retain/recruit staff. Given the estimate of 2 million extra care workers by 2025 in England alone, i can't see how net migration can be restricted to tens of thousands. Think about all of the other sectors of the economy needing to recruit.

 

If Brexit does cause the UK economy problems, then there could be even less money available for care. Government then might say that the plan to cap peoples care contributions to avoid selling their homes will be scrapped. Instead they might say that if people need to go into care homes, that if they cannot pay the fees, that they will have to sell their homes immediately and allow councils a charge against them.

 

Once reality starts to kick in sector by sector in the economy and people who voted leave start to be faced with consequences of their votes, then government will be under massive pressure to stop Brexit.

Once reality starts to kick in sector by sector in the economy and people who voted leave start to be faced with consequences of their votes, then government will be under massive pressure to stop Brexit.

 

But all they hear is 'will of the 37% of the UK populous who were conned into voting leave for many different reasons, pretty much none of which will come about.

 

May has apparently 'ruled out' a May 4th snap election to take advantage of the Labour parties final decent into meaningless nothingness

 

Labour corbynista minions say we should now give him two years rather than the one year that was originally stated needed for the the Carbuncle on the backside of the Labour party to ;turn around' the public's derision and distrust of him ....

 

So May the 4th probably isnt vote Mayday then. She should have done it BEFORE triggering article 50 - in fact when Cameron resigned. It gets untidier and more dishonest by the day.

Tory candidate has said she is 100% against the downgrading ofthe local hospital, BUT Teressa May has repeatedly avoided confirming any support for her candidates stance even in her visit there to 'support' that Tory candidate. Which seems to clearly show that the NHS will get continued cuts from the Tories and the local hospital will be downgraged. No last minute 'announcement' should be trusted any more than UKIP lies regarding their intent for healthcare.

 

UKIP

Have long standing full blown shut down/privatise policies which are changed very temporarily (they lie) if its in their interest to do so.

 

Labour

Support for NHS is part and parcel of the Labour ethos as stated - but with Corbyn - who knows what that will be. Corbyn has had the sense to stay away and not drag the none- Corbyn local labour selection (unlike May).

 

Lib Dems

probably the most rational and coherent policies on supporting the Energy/Nuclear and the NHS and healthcare

 

 

Brexit or Bremain

 

Tories

- With Maybe Maybenot who knows what we will get - but probably hard brexit with some bits for the rich and privileged (and maybe International car manufacturers and International bankers)

 

Ukip

a subset of What the Tories offer AT BEST - and they LIE.

Labour

Whatever the Tories want they will support except for 'moral objections'

 

Lib Dems

Anti Hard Brexit. anti Brexit

 

 

 

Nuclear energy

Tories

Yes as long as someone else pays (oe at least someone else who we can give unlimited taxpayer funds to so they can say someone else is paying).Toshiba in this case. So the Tories are hiving off our energy utilities and current and future tax payers money to foreign interests

BUT look at the massive problems Toshiba and EDF are having with their nuclear energy businesses - EDF and Toshiba are proving consistantly unable to meet their nuclear commitments around the world)

 

Labour

Corbyn is 100% anti-nuclear in all its forms - and pro disarmament in an increasingly dangerous world - but has no real plans for acheivable alternatives

 

UKIP

You simply cant believe a word they say.

 

Lib Dems

For nuclear energy, 'broadly' against weapons and nuclear armament escalation. May be far more 'UK owned nuclear positive' than the Tories

 

 

 

 

So if your overwhelming issue is:

(provided the voting is based on informed logic (fat chance) rather than emotive rhetoric)

Bremain = Lib Dems

 

BREXIT = Tories (with some deals for the fortunate) or UKIP (just tell 'em to FO)

 

Support The NHS = LibDems or Labour

 

Destroy the NHS = UKIP

 

Nuclear+ - its a vote for Libdems or Tory (but more/all owned by foreigners with the Tories)

 

No Nuclear- = Labour

 

 

Mix and matches

 

Privatise/end NHS and end Healthcare and Hardest Brexit = UKIP

Slower Privatisation/erosion of NHS and Hard Brexit = Tories

Nuclear+ AND Brexit+ = Tories

NHS+ AND Brexit+ = Labour

NHS+ and Bremain+ = Lib DemsNuclear+ AND the NHS+ = Lib Dems

Will be a massive statement by the public if LibDems win even 1, or even gain LARGE voter %

 

Tory losses will be further damnation on the may government that:

Is not elected and hence has NO mandate
