      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone, I am having trouble with a gym I joined the beginning of September at first it seemed like a reasonable gym how ether about a week into it a direct debit came out when I had no money in my account I received a letter saying £20 admin fees which I paid which totalled to 64.99 just for the signing up off the gym I toward the middle of the month when 19.99 direct debit was going to come out I had decided to leave the gym already as I was not liking it or their admin charges as I often cock up direct debits so I cancelled it and received further letter of £20 admin charge I was unaware of any of this stuff as when I went into the gym to join I just saw a big poster saying no contracts but now realise that is only if you pay 24.99 a month and the sign up fee. I am now stuck as I have received a letter claiming I now owe HARLANDS GROUP £90 or pay of the rest of my contract £220 I have not used the gym since maybe the 20th September or less I have emailed Energie who I thought ran the gym saying I just want to cancel with no reply, when I joined the gym I didn't even see the contrAct just filled in a form on the computer at the gym which looks like the one on fit4less Banbury website What are my options Do not pay in which HARLANDS said will pass my account to debt recovery, go into the actual gym and just ask them what the crack is, or send some letters to try get a hard copy of my contract which I have not seen at all so did not know about any of my terms (stupid I know)

Feel like I'm just gonna have to stick with this 12 month contract but I can't afford all these nonsense extra charges I did not join up for this I would have stayed at my other gym if I knew about these

In the meantime, stay OFF the phone, and deal ONLY with the gym direct, which Gym is it and where??

 

You can completely ignore any and all of these penalty fees, they are unenforceable.

 

A DCA is completely powerless so you can laugh at their threats of passing it to them.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

It is Fit4less by Energie in Banbury the gym in question, I will wait if I do how ether have to honour whatever was agreed do you think that they would accept a 50% reduction of £99 to clear the arrears and then just resume the gym it's not what I want to do but if my choices are limited I would rather that then pay £279 without actually using the gym for longer than a month as stated I did not see the terms when signing up but googling fit4less banbury terms and conditions I found a 1 page t&c which may or may not be what I'm on ?? Confused badly for a 22 year old naive man these companies can really milk people like me
