      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi.

As a newbie, I hope I have done the right thing.

 

 

I tried to post on the appropriate forum.

But got a message saying they were not accepting any new posts.

I really need some advice.

 

my husband was accepted for an Argos store card in 2014.

We only used it once and my husband paid off the balance.

 

 

He is very shrewd like that.

You can therefore imagine our horror when Argos got intouch to say that we had not paid for a ps4, that had been delivered to an alternative address.

 

 

My husband explained that this was nothing to do with us.

Had we ordered anything we would have made payment.

 

 

They continued to threaten us with court action and bailiffs,

so my husband asked for a copy of the signature that was given at the so called delivery address.

Argos responded by saying they no longer had it.

 

 

We then contacted the Ombudsman with all of the details,

they had obviously contacted Argos,

as yesterday we received a letter saying please see attached proof of signature.

 

 

It was a blank box. Nothing. Can someone please help us. We seem to be going around in circles.

Stay off the phone, they get excited and start making things up as they go along.

 

Have you checked your credit files?

 

If not do so, Noddle and Clear Score are both free.

 

Stop, relax, there is absolutely nothing to worry about, stay off the phone, keep everything in writing.

 

If they ring, laugh and hang up.

 

Check your credit files first, when you say they 'got in touch' how exactly? By letter?

If so, can you scan and post it up, removing ALL identifiers first.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Thank you for responding. I will upload a copy of the letter today. Does my husband have to pay for something he did not order or indeed take receipt of and there is nothing to prove otherwise. My hubby is worried sick. He will check his credit score and let me know at lunchtime. Thanks again

Of course he doesn't. The min wage lackeys on test phone will say anything. It's what they're paid to do. Demand full proof of the transaction from argos including where and when it was made and where it was delivered to, then speak to your local police dept about fraud

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Absolutely NOTHING, can or will, happen overnight, DO NOT pay a single penny for something you never ordered or received.

 

Once your OH has checked his CRF and confirmed there is nothing on there, then it can be batted back to Argos.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Thank you so much for your help. Tbh I cannot see how they could chase for money, if they cannot supply proof of any kind. We won'the worry quite so much now. Perhaps not. My OH has just come home and confirmed that it has been put on his credit file as well. Can they do this when they have not provided any proof?

You need to send Argos a Subject Access Request - this will cost you £10.00 and should provide all data they have in connection with your OH's relationship with Argos. This might even provide the address to where the item was sent.

 

 

If your OH's credit record has been blighted because of a fraudulent activity and you have advised Argos of this, then you should be able to take this further.. eg court action against Argos themselves.

Hi Argos have supplied the address the item went to. I doubt very much that they will admit anything. That is all they have provided.I will use the template letter today. My OH is a worries. The sooner this is sorted the better. Thank you most kindly.
