a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
However strapped you are & difficult it is - see if there's someone else you can get a loan from. Post on the thread about managed loans & I'm sure someone more knowledgable will be able to help you better than me.
From experience though - the HSBC managed loans are almost the worst on the planet. In my case, the second I went onto that I was stuffed as far as loans etc from anyone else. (Forced (sorry - sold!) by HSBC as my ONLY option & further bullied by them telling me I wouldn't be able to get credit anywhere else & this was my only option) I paid £104.00 p/mth, of which £84.00 or thereabouts was interest alone. Finally after paying religiously every month for 3 years I managed to settle the debt which was still £6700 - the initial loan was in the region of £2k.
Re monthly charges - I don't actually think they have a maximum limit do they...? it doesn't appear any of them have a maximum monthly limit. On a Halifax A/C they bounced 2 DD's for £4.99, charged me £78.00 for doing it, & these only bounced as they took 117.00 the day earlier in charges without advising me when they were doing it. That month I received a further £195.00 plus the over the overdraft charges cos they reduced that because I'd had so many charges that month!!! Kewwelll - easy money eh!

Heavens - You ask me?!! It's so tough to be in that position.
The best thing you could do would be to have a look at the managed loans thread - hopefully that will get you to it.
I only go by my experience & it was long & difficult & took years to get rid of it. I had little or no option at the time but severly regret it - the experience helped me send that rejection letter saying no thanks to £2k yesterday, knowing I hadn't even enough for the grocery shopping this week!!
I'm sure if you ask them in there, or maybe pm a mod they could give you some better advice than me.

I haven't accepted it. I am more annoyed that he insisted that the charges were lawful and he said that total charges consisted of £25 penalties so in other words, do something wrong and each time you're fined £25.
when I got off the phone though, i thought to myself... well.. how come one month i got total charges of £30?? I'm going to ask the next one WHAT exactly costs £25.. and can they give me a Breakdown - I know it won't get me anywhere, but the call centre staff are only half hearted in their argument that the charges are fair... they all stammer and escalate the calls

Capital One - sent CCA request - 15/01/09 - received CCA and also offer of £67 which I am not accepting.
NatWest - sent s.77 letter complaining about default on file 15/01/09 - *WON* Default removed within a fortnight!!
NEXT - 7/02/09 - sent further letter reminding them of breach of DP
Cap1 - 7/2/09 - Accept part payment/reminder of default to be removed
i had a managed loan years ago from HSBC, i didn't even know what it entailed worst thing i ever did. the other persons right they take everything off you credit cards etc and you wont get anything for 6 years.
Too right! Judging by my statement copies - they make it up half the time by the looks of it.
How about re-visiting Martin Lewis site MoneySavingExpert.com ad-free, free to use, Consumer Revenge! & seeing if he's got any good advice/offers about credit cards to tide you over? If you could do a balance transfer with 0% it would probably make a big difference - least you're paying the debt off then. I later managed to get a loan with Egg & they seemed much more reasonable than some - less keen to cripple perhaps..? Worth a go maybe?

PS - Get the claim started for your old business account NOW! If you have online banking you can access the statements straight away - then straight into the pre-lim, or as a few have done - lba - get legal on their A$$es!!
Why should you pay even more over in unfair charges just to line the dragon's den when you're in that position because of unreasonable & illegal fines from them?!!

I have done, got to file the MCOL in next couple of days on that business account. And another LBA to go off tomorrow on personal account. Gonna add contractual interest too... it's not much more but it's better in our pocket than theirs. I've found though, that with starting 4 accounts at once, it's getting very demanding work!!
