Sunny loan paid to non existance acount number - are we responsible for Paying it back?

Hi

 

I'm looking for some help regarding a sunny loan that my wife took out two weeks ago.

 

My wife applied and was accepted for two hundred pounds online

but she made a mistake with her account number,

one of the buttons stuck and duplicated a number,

so the money never made it into her account.

 

She phoned sunny who told her that she would have to check with her bank

to find out if the account number they sent the money to actually existed

and if it didn't that the bank would transfer the money back within five days.

 

We went to the bank

at first they didn't want to confirm that the bank account where the money was sent existed or not

we managed to speak to someone who told us that it didn't but that sunny would have to claim the money back

as they would not send it automatically.

 

We again spoke to sunny who refused to claim the money back

and told us it was our responsibility to get the bank to return the money not theirs,

back to the bank we went

who again said as it was sunny who made the transfer they would have to claim it back..

 

Now we are in the situation that we're going to have to pay the loan back next week

even through we've never actually received any money from them...

 

Has anyone got any advice on how we can handle this

or any legislation we can use to get them to just claim the money back?

did you advise them [sunny] of the issue within 14 cal days of the mistake happening?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Even if you were to cancel within 14 days then Sunny would view you as still liable from the money anyway in Sunny's eyes as it wasnt there fault.

Now if they had done the correct checks (Experian have a product to verify Bank Account Details etc for businesses) then they would have realized that the account information was incorrect.

 

The bank are correct as they would have to claim the money back. If you have notified them but arent getting anywhere, then raise a complaint to the following email addys

Advise them of the issue and advise gem you are not responsible for them doing proper checks.

Thanks for all your help, sunny have just phoned my wife and have told her that they've found the money.

Apparently they've had it since the thirteenth but have only just realized it now despite the numerous phone calls we've made in that time.

Funny how they've suddenly found it after we threatened them with the fos but again thanks for the help
