New to this so would be grateful for help:

 

When I joined my company 5 years ago, my employment contract said they would contribute 20% into my pension fund. I have just found out they stopped this 2 years ago and didn't tell anyone.

 

They are trying to use a clause in the contract which says

The company reserves the right to change this pension policy in order to conform with Government Legislation ..

 

Are they legally correct please? I was not aware that the Government have made any changes that allow this

that will depend on the deed of trust for the pension scheme, not legislation. If you know who the managers of the scheme are you can ask them for a copy of the scheme rules and other legal bits that cover such things.

Secondly, are you still paying into the scheme? Chances are if you are then the company is not being honest

Sorry for the delay in getting back to you, but I have not been feeling well. I am going to take your advice and talk to others and look at all my paperwork..

I think I have stopped paying in now but will check that too.Thanks so much for your time - your comments have been a great help

Hi and thank you for your reply. I have not been well so been off the computer for a few days.

Company didn't say anything else. Don't seem to have had a statement for a while either.

But now armed with this information I will go to the Accountant and find out what is going on.

They probably also have a policy on Pension Scheme/Contribution so make sure and ask them for a copy of the policies.

 

Important - Make sure you specifically ask for the policies from when your contract started - To Date (you need to know the companies policy on this at the time you joined till now).

 

How many employees in total or roughly are employed by the company?

 

Are you with a Union?

 

Was there any consultation that took place on the possible Pension changes during this period?
