I have a problem with a Credit Card on which due to unfortunate circumstances

I can no longer afford the payments demanded.

 

 

Way back in the past when I had similar problems you guys were able to help me out.

There was a section here on this forum which contained several pro-forma letters

which I used to get the Credit Card Company to close the account,

freeze the balance without adding any more interest,

and accept a much lower payment repayment plan.

 

 

Can anyone point me to the section where I can once again find these pro-forma letters

and make use of them?

Hi,

 

Have a look in the library 'Green' tab top left of the forum page, should be under 'Debt Collection'.

What's the story with the card, any charges ect you could re-claim.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi dx,

 

The story goes like this.

10 years ago or so I got into difficulty after a business venture went badly wrong.

I found my self left owing a deal of money to banks and several Credit Card Companies that I could not repay.

 

 

I used the pro-forma letters I found here to write to them all

and in the end I got them all to agree to one pound per month

and to freeze the balance and not add any further charges or interest.

That was a great relief though it did give me a very poor Credit Rating.

 

 

Then a few years ago I kept getting things through the post saying I had been selected

and pre-approved to apply for a new Credit Card.

 

 

Eventually I succumbed and sent off one of the completed application forms.

To my huge surprise it was approved and the card arrived with a limit of £1,000.

Over time this limit was increased in stages until it is now £3,000.

 

It is a Visa Card supplied by Vanquis Bank which I have been paying the

just over the minimum demanded monthly for over 2 years now.

But my income is limited and now I struggle.

 

 

My only income is Old Age Pension and PIP which I get because I am disabled and full time wheelchair.

 

 

As a couple, my wife and I (She also receives Old Age Pension and DLA as she too is disabled)

we also get a small amount in the form of Guaranteed Pension Credit.

 

 

I beehive that all this income is classed as "Inalienable Benefits" which it would be difficult for the Company to place a charge on. Does this help and what advice would you give?

DLA & the guaranteed disability bit are yours to spend

and do not count as income.

Many thanks for that info. Do you happen to know if "Guaranteed Pension Credit" also falls into this category of "Inalienable Benefits"?

Hi dx,

 

Thanks for that info. As I read it, as "Guaranteed Pension Credit" is an income related benefit, then it too is classed as "Inalienable" under Section 187 of the Act.:smile:
