The £10 fee with a DPA request is to get the details of the charges they have made on your account over the last 6 years. Is this what you wanted, or had you something else in mind?

Whereas I have been a customer of XXXXXXX Bank since XXXYEARXXX and whereas I consented in my contract with you to the disclosure by you of certain data to third parties, at no time did I consent and neither was it within the contemplation of the parties to the contract that I did consent to the processing by you of that data in any manner which would be unfair or inaccurate or which in any way would breach The Data Protection Act 1998

OK so you want A&L to stop passing your information to the CRA's. Are you making a claim against Alliance and Leicester, and have you placed your account in dispute? If so, do you have some reason to believe that information relating to your account is being sent to the CRA's. I'm trying to help but I'm still not clear what the problem is.

A+l have passing my data onto equifax etc despite me disputing the balance as it is made up of repeat charges. Also the SAR i sent to them does not seemed to have worked. Where as when isent this letter off it took them 1 week to reply.

They will contiinue to pass info on even if the account is in didpute.
Have you got a default on this account - is this what you are trying to remove?
They have 40 days to comply with your SAR - and normal bank correspondance as per the Banking Code should be dealt with in 5 working days - which is why there is a difference in response time.
When did you send your SAR?
Have you informed the bank that your account is in dispute?
If the 40 days for your SAR has passed then send a letter before action for non-compliance with the Data Protection Act which can be found in the Bank templates library. Also write a letter to A&L informing them that you are officially placing the account in dispute as you do not agree with the balance due to charges which you believe to be unlawful and will be claiming back, and they should take no further action until the dispute is resolved. I am not sure if you have done this or just disputed them verbally.
