    Default Claiming before starting an IVA ?

    I have told a friend of mine about this website. She is absolutely pennyless and with Christmas approaching very depressed. She lost a lot of money on the Farepak scheme too, so not alot is going right for her.

    I am reccommending her to start this process but she is so worried about it all.

    My question is this. She has literally just started an IVA program. The creditors haven't even been told yet, she only sorted it all out yesterday with Debt Free Direct. Can she claim knowing she will be going down the IVA route? She currently banks with the Woolwich with a overdrafticon on the account. She is setting up a step account with Natwesticon as her "new account". The claim will be against the Woolwich, but as this account will now be under an IVA, will that matter?

    I personally don't think it will matter, it's her money she wants back. But I don't want to advise her wrong and would welcome any input.

    Im in year 2 of an IVA. I had a successful claim against Halifaxicon for £3000 and didnt notify my creditors (bad I know) - but they havent found out about it and Im not about to declare it unless I have to. Im currently doing a claim with Woolwich for £2300 - they were one of my creditors. TBH by the time she has had any success with her charges claim her creditors would have long sold on their debts to third party companies and are unlikely to care that she is in an IVA or not.

    I received an initial letter from Barclaysicon basically telling me to sod off cos they had already kindly written off £1000 of my debt but it's still unlawful what they are doing regardless of if you have debts with them or not.

    The absolutely most full proof way of doing it is obviously to get her to speak to her supervisor but again TBH there's no way now if she is starting a claima gainst Barclays she is going to see her money this side of Easter - its not a quick route. I have been doing my claim since June and have just been issued a court date for January!
