Cabot are fishing on Cap1 card 'debt'

Hi all,

 

I wasn't going to post about this until i've read another thread on here

(someone has had a claim put in against them by Cabot)

 

I received a letter from them last week stating that they believe this to be my new address.

Please get in touch to discuss your Capital One account'.

 

The account defaulted in September 2010 with no acknowlegemnts in between. Account opened in 2007.

 

My question is,

if I CCA them, will they still go ahead and issue a court claim anyway?

were you given notice of the debt being assigned to Cabot or are they acting on behalf of Capone?

 

 

If the latter do nothing as Cabot cant do anything themselves.

 

 

If the former, have you changed address in the intervening time?

No addy change then it is a fishing expedition.

 

I would hold off on the CCA request until they decide you are the person they are after

and send a lba and then send the request

I have been given no notice of assignment to Cabot from Cap1 or Cabot themselves, but this is probably due to me moving address. The letter received was just a standard template 'we believe you now live at this address.

 

Just wondering if a CCA would delay any further incoming letters from these guys till it hits SB status

CCA response received. They don't have it on file and have requested the original from the OC. Stated that they have 40 days to provide it. Isn't it a bit misleading for them to quote the allowance for a SAR request, and not a CCA?

40 days urghhhhhhhh 12 +2 these cretins not know their hand from their elbow , they do try it on they think the defendant is thick, but they are to even contemplate that. trouble is they nmislead the vulnerable -ike tol cut their Hxxx oxx

I refer to a letter from Cabot dated xx.xx.xxxx., in which it is stated that Cabot hopes to comply with my sections 77/78 request made under CCA 1974.

 

Please take not Cabot WILL comply with my lawful request within the statutory time scale of 12 + 2 working days failure to do so WILL result in a copy of Cabots letter being forwarded to the OFT/FCA, and a comment on Cabots conduct in trying to mislead me in to believing the time scale is 40 days which I am well aware applies to a Subject access requesticon Under the DPA 1998.

WOWWWWWWWWW leave alone they are in default and they know it, all the rest has been tried in the past to no availail, know one person who did similair and all stops put out to the detriment of the individual they ended up paying very dear.

No drama with letting the FCA know that this shower are continuing to attempt to exploit a debtors lack of knowledge by incorrectly, and knowingly IMO, inform the alleged debtor that they have 40 days in which to supply the CCA when it is crystal clear it is 12+2 days and has been for some years.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
