    • The NTK is pretty good at complying with the Act  as is the Notice to Driver so no help there. I seem to remember OPS getting hammered by a Judge [in brighton I think] so they seem to have tightened po their act since. The organ grinder is the MA and the monkey is OPS.
    • @jk2054 and @BankFodder - Your feedbacks in posts #199 and #202 have been incorporated into the attached WS. As usual, amends are in blue in this draft. Based on other WS drafts I've seen where the issues in dispute are part of the WS, I built my first draft WS in the same format and hadn't seen it to be an issue before. You will notice that the 'witness statement' has been replaced with 'Claimant's Statement' so that issues in dispute does not need to be on a separate page before the WS. This is especially given the work that has gone in to reduce the size of the WS to 8 pages. Also thanks for the suggestions re: confidentiality - I agree with your views and will stand firm on this if a condition of confidentiality is brought up. I have not been approached by Evri on this forum or by email. I haven't yet had success in paying the hearing fee. I am calling the court as often as I can (during work breaks/lunch etc.) and have sent 2 emails to the court requesting a call back. If i don't have any success by the end of this week, I'll send another email chasing for a call back. @BankFodder - Also attached is an invoice from Packlink which shows that I was charged by Packlink for these services: "drop-off at EVRi - Next day delivery" and "Proof of Delivery". It also has the payer's address and there are "Origin" and "Destination" fields which have the postcode of the sender and the recipient (I have redacted personal details in the attached invoice).  I am already including this in my evidence bundle (without the redaction) but wanted to share this redacted version so that other people can consider this as example in their bundle of Packlink and Evri's contract being instigated by the sender of the parcel who has paid for the service, and further shows that there is information in the invoice to identify that a third party beneficiary (sender / recipient) is present in the contract between Packlink and Evri.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well That was an interesting experience.

 

Was wanting to get a partial settlement and he initially said he could offer a 5% discount

and then he said the maximum was 10% so I wasn't interested.

 

He then wanted to go over my income to try and get me to pay more but obviously I wasn't interested in that.

Probably the least professional and useful debt collector i've ever spoke to.

 

Might be helpful for people who want a significant discount to know you're wasting your time.

 

Phoned capital one and they were willing to give me 30% but that's not as much as i'd want.

 

Maybe I'm expecting too much!

When did the account get opened

When was the last payment made on it

Who owned the debt

Has the debt been sold to a DCA

They're both credit cards and I know I owe the debts.

 

 

I don't mind paying them off but I don't earn a lot so it's hard paying them off in one payment.

 

 

I'll just continue making my monthly payments for now

and I've already paid off two debts I owe so just three to go.

let us get one thing into your mind - the originator does not want to know you due to defaults etc so they sold your account on for PENNIES in the pound, the buyer buys for peanuts, and hope to make a fortune from your with their threatograms etc

 

Now is your alledged debt enforceable? i.e the correct paperwork as per legislation. any charges (illegal), PPi,

 

 

look to find out before all this I owe them monies, they could owe you in the end, hence Know your rights!

Whilst it is admirable that you're communicating with these powerless DCA's, it isn't actually going to work to your advantage engaging these fools over the phone.

 

You MUST keep everything in writing, as what they say to you over the phone, is a fabrication of their tiny minds, and will have absolutely zero comeback unless you are recording these calls?

 

The only time I ever ring them, with the help of Truecall of course, is to bait them and tie them up in knots.

 

How much of the debt is the cards fees and charges?

 

When did you take these cards out, pre or post 2007?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I know you're all trying to help but I really am happy to pay off these debts.

 

 

I was young when I ran up these debts and i'm a bit more sensible now.

 

 

I have now asked Lowell to reduce my payment amount

so I can put the money towards more important things at the moment.

 

 

I'm currently paying by direct debit and I expect them to say no and if so I plan to cancel the direct debit and pay by standing order so that i'm in control.

 

I'm not impressed with their attitude to be honest and all other debt collectors have been far more reasonable and helpful.

I would definitely change the Direct Debit to Standing order irrespective of whether they say yes or no to your reducing payments - as you say, it provides you with greater control.

 

If there are any default/late payment fees or PPI then you should consider making a claim for the return of these - even if they are only refunded to the accounts.

Thanks and I pay all my other creditors via standing order so I don't see the issue myself but lowell just like being difficult.

 

It will take about four days for a reply so I'll let you know what they say.

Like I say, it's admirable, and I'm not saying for one minute that you shouldn't pay what you owe, but how much of the total owed is fees/charges?

 

Asking them to reduce payments will be as much use as indicators on a submarine, they need telling, and you need to take control of them.

 

Credit cards (unsecured) are 'non priority' debts, so they come AFTER everything, including socialising.

 

Do they own these accounts or are they simply the gophers?

 

If they don't own the accounts, then there is no reason to pay them at all, and you should pay the OC direct.

 

Paying a DCA simply gives them profit to harass other debtors and stay in business, they need to jump through hoops before anything as risky as a direct debit is ever set up, they control your bank account, and if they sense you might be getting wise, then they can empty your account.

 

'All' the other DCA's (who?) are being reasonable and helpful because they know you're a cash cow, and they're not going to upset you for fear of losing their regular income, much better to appear malleable and compliant, rather than you finding out you only owe tens of pounds as opposed to hundreds, you don't seriously believe they have your best interests at heart do you?

They cannot insist that you pay them by direct debit ! Use the details you have for the DD to set up the standing order and it will get there.

Just an update, they accepted my change to a lower payment and by standing order, no questions asked. They even sent me a text asking for feedback on their customer service. Maybe they're changing their ways! haha :jaw:

 

Nope. Theyre laughing hard because you agreed to pay an unenforceable debt and are fully willing to be cashcowed. Why not take that money and burn it. It will achieve the same thing.

 

You could even save ALL your cash by sending a simple £1 CCA request to lowells.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Some debtors we can help see the light. Some debtors are blinkered. Some debtors just won't take advice. Finally some debtors think DCA'S are god. Oh how I wish they would listen to us!!! Lambs to the slaughter... blindly, willingly and blinkered to
