Alliance and leicester have applied bank charges to my account on many occasions for returned direct debit payments etc, on one occasion they applied a charge to my account that left insufficient funds to cover a secured loan that i had outstanding on my vehicle, this caused the firm to place a repossession order on my vehicle! It was my last warning from the loan company but it was still A&L's charge that caused the final default!
Also i am a father of 3 young children 3yrs, 17 months and 3 weeks. My partner has been seriously ill since the birth of our first and is unable too look after our children hence why i cannot go out to work,We have to rely on state benefit payments to live on. A&L have on more than one occasion taken money from my account that has left our family in serious financial trouble and suffered because of it. As state benefits are "how much the law says you need to live on" So I sent a letter demanding the refund of the charges and the cost to replace the vehicle that was subsequently under order for repossession due to their unlawful charges,Or i would put in further claims for suffering and hardship they had caused my family due to them taking their unlawful charges from our state benefit payments, needless to say they declined my offer, as the charges were only for around £300 but the compensation for vehicle and suffering to my family equated to £8700 or there abouts!
What do you think my chances are of getting A&L to pay the compensation aswell as the charges?
Hi. Sorry to hear of your dilemma. Im know I read on here somewhere that someone sued the bank for a bank loan that they took out to cover the their overdraft caused by bank charges. The argument was that if it wasnt for the bank and their charges, they would not have needed to the bank loan. This might be a similar sort of thing. I will see if I can find the link for you. Also you need to look into the repossession of your car. When you have paid more than (I think its) a third, they cant touch it.
Actually a very helpfull gentleman Called Tim Russell who gave me this website address did say something about a case like that and advised me to come on here and seek out some advice on it.
As for reposession well between me and you, well and half the worl online i didnt let them come and take it, they have sent the repo guy 3 times now but conveniently i have been out every time i have CCTV on my front door so i know who's there at all times. lol

Is it looking like Natwest are going to court on it and actually defending it or do you think they will fold at the last hurdle?

Well it looks like i may be in for a hell of a fight if i go ahead with my claim, but what the hell, A&L can suffer just like we have had to.
Natwest also make you go to court then they pay up on the last day! Not sur about A&L but they are probably the same. I think their strategy i that most people will be put off of cant afford to issue a MCOL. Sad really, cos I think a lot of people just cant find they money to do it. Have a read of some more threads involving A&L to get an idea of how they usually play it.
