Well, after reading around this forum, I have decided to claim my charges back from Abbey National.
They're no way near as high as some people's so I feel a little silly but, it's my money so.....
Luckily, I don't have to deal with the DPA as I hadn't incurred any charges until June 2006 and their wonderful online banking system gives me access to the last 6 months worth of statements.
I have already written and sent off my initial claim letter and have received a standard reply of 'it'll take a month to investigate.'
My question now is - their 14 days runs out Monday, so can I write again after Monday?

Send your letter before action (by Recorded Delivery) on Tuesday, and then expect to file in court at the end of the time limit (Abbey won`t do anything positive until you file)

Well Abbey's 14 days were up today - and I got a letter through saying the charges weren't unlawful but as a good will gesture they have refunded all my charges to my account anyway (I checked online and they have!). Can't believe it, all I did was send off the first letter. I suppose it's because I wasn't claiming thousands. Best thing, is tomorrow I have an appointment with them to shut my account down! They may have given me the money back straight away, but they caused me so much stress over the last few months that I really want shot of them.

It`s a shame they failed to use that tactic with mine, it would have saved them a few quid in court fees, and finally appearing in court (which I know they have not ever wanted to do, but will have to now with my one)

Mish well done with that - despite their saying it's a gesture of goodwill etc.. it's plain they are n the wrong? It's a pity they are messing around with the people who have the bigger claims isn't it? From many of the threads I have read they have given lots of people grief in the past and now they continue to make life difficult for these people rather than hold their hands up and admit there have been problems!!

Oh definitely - it made my day. I was so annoyed when they took the charges from me because I had only messed up myself once (and even then all Abbey had to do, was not allow the card payment through and all the charges could've been avoided - all the rest of the charges were charges because of charges!
I have told a couple of my friends to have a look at the website and told them that they should seriously consider doing it. So fingers crossed they'll proceed and get what is rightfully theirs back!
Not quite sure how to proceed with the storecard (GE Money) but will have a read on that - I'm determined to get the late payment fees back as I'm pretty sure they would clear my outstanding balance with them! Can you claim back charges that are only £12 a go?? (I say only compared to the £35 I have previously been charged for returning a £16 direct debit)
Yes - it's the same letters edited for your storecard / credit card is similar process to getting your money back off the bank - you claim the Late Payment fee, and charges etc.. there are lots of good threads in the "other banks" section that show information on Capital 1, MBNA etc.. cards - have a read and you'll see it's similar stuff - get your confidence up to chasing your card money back Have fun!!!

Have you tried phoning James Arundale? if not, it could be worth giving him a call to ask if he would like to discuss settlement the day before the hearing.
You`ll proberbly find that he`ll go into a Blind Panic as he sees yet another case slipping through the net (They are now struggling to cope with their caseloads ).
I`m sure James would appreciate the call, and whilst you`ll still need to attend court on Tuesday, it should just be to ask the court for a delay as you have `Struck a Deal` with the Defendant, they will suspend for a month awaiting confirmation from you that the case has been satisfied (ie; you have your money).
As for Abbey ever appearing in court, yes they have, at directions hearings, but the likelyhood of them ever appearing to Justify and explain their charges is fairly remote, infact, I would think that Watford have a better chance of staying in the Premiership this season, than Any bank actually appearing to disclose their charges structure!
And before anyone starts on me about ridiculing Watford FC, I`ve supported them for 40 years:cry:
