    Default Stobbie -v- Barclaycard

    I sent the DPA letter with cheque and received no response, so off went the breach letter still no response. Yesterday I received a letter saying that they don't agree with the OFT decision etc, etc but as a gesture of goodwillicon are sending me a cheque for £80, which I also received yesterday, "which is the difference between the charges incurred and the £12 (I thought it was £10) fee.

    They have not sent me any statements but from the ones that I have already (I closed my account in 2003) I estimate that the charges amount to £160. What do I do now? Anybody had this happen to them?

    looks like you've been charged ten times (80/8) giving a total of £200 in charges, so minus the £80 already refunded leaves £120 still owing. Its not to clear from your post but have you sent off your preliminary letter for repayment??

    When did you send your SARicon? The ICO are on the 'verge' of making a statement regarding bcards micorfiche so might be some movement there in the near future. Have you considered charging contractual interest on each of the charges??http://www.consumeractiongroup.co.uk...-interest.html

    Hi,

    Thanks for your response. I sent the SARicon on 13.8.06 then a non complaince letter on 5th October which I would say was giving them more than enough time to respond. Should I reply now saying thanks I'll take the £80 as a part settlement but I intend to pursue the rest together with contractual interesticon?

    Really appreciate your help with this, lots of people would give up I think without the support of this site.

    Yep, accept as a partial payment and pursue the rest. If you want to claim contractual interesticon you need the dates upon which you were charged. As you dont have them about all you can do is spread them evenly from april 2001 to to when you closed your account. claiming 17.7 % apr should net you around £200 in interest
