Well - update as follows. Dont know if anyone is out there or if im not posting correctly, but here goes. RBS summons me for £6k+:o ! Sis directs me to CAG ! I cease prev negs with RBS Sols and have just filed defence/Counterclaim. Sols sh*t a brick (one assumes! lol). Docs req from sols as disclosable (awaited). Let from sols - they are dissapointed Im no longer round neg table(aaaaahhhh! can we reach amicable conclusion? ). Docs sent to date only deal with charges since sols had file. How naive that they think those are the costs Im challenging . Interesting to see if they proceed to court on their claim as it stands as any decision will be binding on other claims.
Anyway hope all you are ok out there - updates wil follow.
Well good luck, yours seems a little less straightforward than most. Presumably you will be combing through your statements to see what you can claim?
Prelim letter sent to RBoS 8/8/06 letter passed to another department...and Tommy fob off arrived
LBA sent 29/8/06 £2646.64 claimed - no reply
Claim entered 26/09/06 £2716 + interest. Not acknowledged so Judgment requested 17/10/06
Judgment in default 28/10/06
Cheque finally arrived 24/11/06, ring Group Litigation on a daily basis - you know it makes sense...
GE Money prelims sent for ERCs and charges on 2 accounts 18/10/06
LBAs on 2 accounts sent 5/11/2006
2nd claim against RBoS in 10/11/06, with threat of compounded contractual interest, c'mon now, concentrate...
To recap they issued summons against me £6K+ (so not small claims - important as any decision would be binding on other claims) - I enter defence & counterclaim (still awaiting statements/docs etc from them). RBS sols just confirmed theyve discontinued legal action and are bearing own costs and want me to do the same!!!
HOWEVER..... They have forgotten to enter a defence to the Counterclaim (Very silly of them!!) and the Counterclaim action still runs in its own right - think Ill drop a line to nice District Judge Hickingbottom (yes really!) at Court and ask him to enter Judgement for the Defendant in a sum to be confirmed when documentation diclosed HHOOOOORRAAAHHHHH!!!

Nothing heard from RBS since they discontinued their legal action against me and no documentation received to date. As their sols no longer represent them, not sure who to write to at RBS, so deceided to write to the Court instead!!.
Anyhow nice DJ Hickingbttom has read my letter and I have today received a Judgement order in my favour against RBS in a sum to be determind by the court and a directions hearing to be heard 10.1.7 HHHOOORRRAAYYYYYYY!!!!!!!

I am so pleased you had the courage to stand up to RBS and just wanted to add that that you are not alone, (even though your other RBs thread received no replies and it must have seemed you were alone).
I am not sure what your counterclaim was for exactly, but I hope that you will continue to go after them for every single penalty they have ever put onto your shoulders even if it means taking out another new claim.
