Hi.

Lowell group contacted me about 2 month ago regarding a debt to provident, I rang them asking what it was and they explained that I took a loan out on the 09/02/2008 I said I don't recognise it and requested a copy of the original agreement. Today I have received a email stating because it's so old none is available.

Here is a copy of the email, what rights do I have.

Lowell Reference Number : *************

Original company name: Provident Personal Credit Limited

Original Account number: *********

You owe: £1339.40

Please provide your

Lowell reference

number when

you contact us

Dear Mr ***********

Thank you for your patience whilst we investigated your enquiry.

We have noted your comments and write to advise that due to the age of this account we are unable to provide a copy of the original agreement at this point. However, all Provident loans are taken in the customer’s own home when a copy of the agreement is left with the customer.

We have noted your comments and having checked your account history from information provided to us, we can confirm that this account relates to loan agreement reference ******* taken on 09/02/2008 for an amount of £1000.00.

A total credit charge of £1047.50 was applied to the account; this interest is front loaded and is clearly visible on the initial agreement you would have signed at the point of sale.

The account was sold to BCW Group (Buchanan Clark & Wells) prior to being sold to Lowell.

The outstanding balance has therefore been confirmed as correct and payable.

You can pay this in full, or discuss affordable instalments by either calling us on 0333 556 5733 (calls from a landline will be charged at a local rate; mobile charges may vary) or emailing us at [email protected] where one of our advisors will be able to help you.

We have stopped collections activity on your account for 14 days to allow you time to get back to us.

In the meantime if you need to speak to us, please call on the telephone number at the top of this letter.

Yours sincerely,

urm..

you should NEVE EVER phobe a fleecing DCA

they are not BAILIFFS

and have

NO SUCH LEGAL POWERS.

the debt is more than 6yrs old

so it is statute barred

so you can totally ignore them.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

That is hilarious!

I know their threat letters are computer generated, but seriously?

Ignore them, if they ring, laugh and hang up.

Did you have a Provi loan at all around this time?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Did you have a loan with them?

I have recently found out it defaulted in May 2011 by checking my noodle report,

I was going through a lot of family issues around that time and it is possible

but according to Lowell NO payments were made to the loan what so ever, not 1 payment,

this is something I wouldn't do,

even if I had the loan I would at least tried,

so to answer your question I am going to say no,

I did not take a loan out with provident.

well it will be statute barred anyway

if that's the case

if they are stupid enough to issue a claimform

the SB defence will kill it dead
