Hi,

I have defaulted with 247 moneybox today they are 1 of the last creditors I need to come to an agreement with. Anyway I have received two calls already from them even though I sent in a repayment proposal over two weeks ago. I found the caller extremely difficult, awkward and bullyish. The second call I received was on my work phone after I didn't answer my mobile. Can anyone please advise me please, I have stated on my emails to specifically contact me via email but they are not listening.

:-x:juggle::banplease:hi email them telling them u will be reporting them to oft /trading standards asap as its illegal for them to phone u at work with harrassing phone calls and tell them on ur email u will record all calls they make to u for reference for oft and that they have ignored ur email and come back on here and let us know xxxxx

Hi, I have asked a payday loan company to remove a default entry on my credit file from a few years ago, they have declined stating it would undermine the quality of their data submission to the CRA. In my complaint to them I stated I never received any default notice in relation to this debt, in their reply they didn't admit sending one. As a result I suspect they know they didn't. Do they legally have to send a default notice and should I complain now to the FOS? Thank you

A default notice is usually sent when a debt becomes delinquent after 2/3 months. This is a statutory notice which is required before a creditor can take further steps.. eg.. start recording default markers on a credit file, sell the debt to a 3rd party, issue a claim.

 

You might need to make a subject access request to establish if one was ever sent. Then make a formal complaint if procedure wasn't followed - in the first instance to their Head/Registered office and escalated to the Ombudsman if no satisfactory resolution.

I have emailed the company to complain, should I go back to them with a SAR or just go to the FOS now as it looks like they have made their decision? I definitely didn't receive a default notice. The account is repaid in full (including interest).

did you state in your complaint to them that you had other payday loans, possibly defaults, ccj's on your CRA files at the time the loan was taken out with them? what were the details of your complaint? i have a similar case with fos at the moment, they basically ignored my complaint too, but mine is for 11 loans over 16 months plus they activated a CPA on a new debit card of mine and took £750 out of account in one go, so fingers crossed.....back to your case, it would seem they like to play the game with fos...all depnds on what your complaint contained i guess
