Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This is all a bit new to me glad i came across the site though. I've basically had enough after checking my account today and realising that Natwest has charged me £90 for honouring direct debits last month this isn't the first time however last month they refunded half the charges - will this affect any claim i make also i've only been with thwm 2 years and total charges only amount to £337 this is however a lot of money to myself being a single parent is it worth it? i think so but will the bank???
Previous refunds won't make any difference. Only £337!! Some people have filed at court for as little as £30
Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later.
Then look at other threads in your bank’s forum, so as you know what you can expect to happen
You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.
There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time
This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.
When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help
Finally the Moderators and Site Helpers are having to spend far too much time dealing with unnecessary and avoidable errors in claims caused by impatience, ignorance or just plain laziness. If you don’t know what to do next, ask. If you don’t understand something, ask. It might be a dumb question, but it’s a lot easier to sort out than a dumb mistake.
Thanks Westy been looking through the forums and was getting worried about paying the court fees up front but just checked the exemptions website for court fees and don't look like i'll have to pay them so a bit more reading and i'm ready to go!
You're welcome. Wish I could get away with a no-cost case, too - but on the otehr hand I'm glad I don't have to live hand-to-mouth, ,except when the NW blodsuckers coma a-vampiring!

Read all about it: natwesttookmymoney - v- NatWest
I know i probably shouldn't be asking this question but if in doubt!! - The spreadsheet shows the 8% calculation do i remove this for when i send of the prelim letter and add it back on when i get to the lba? Thanks just don't want to make a mistake at the first hurdle!!
Don't worry about asking Boo, after all we all had to start somewhere, and it will be a lot better for you being able to avoid mistakes others have made (myself included)!!
Can anyone tell me what the chances are of Natwest making me pay my overdraft back during this dispute worried about them getting nasty and taking it off me on a payday!!!
While it's unlikely that they will actually demand repayment of your overdraft or close your account without the normal 30 days' notice, it's can't be said to be beyond the bounds of possibility. Have a look at my threads - natwesttookmymoney - v - Natwest and New tactic by Nat West? Help, please!, both of which can be accessed via my name to the left of this message. As well as describing what they've done, I've posted a couple of letters I've sent them. I'll let you know how I get on.
Emphasise - open a parachute account. At least then, if you do get a 30-day notice thing, you'll already have something in place. If you can actually put money in it, all the better!
Best wishes
Westy

Had a reply to my prelim basic charges are fair bla bla bla. lba sent today!
Anyone know of any banks that operate basic bank accounts had to go to Natwest for theres (defaulted on a lot of debt and have just received a CCJ) so worried about finding a parachute account. I know Halifax do one but you have to have £100 to open it!
I opened one with Co-operative, who so far have been fab. I have never heard of a bank charging to open an account, are you sure this isn't just a minimum opening balance?
I dont beleive this but just got home to a letter from Natwest stating there cahrges are fair bla bla bla but they will refund the full amount £337 as a gesture of goowill and it is sitting in my account already!! Many thanks to all i dont have much but a small donation is going to be made right now! Thank you
