    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?  
    • Is this place near to you? I ask for two reasons. If you can easily go back, then get photos of the signs.  On GM and Parkopedia there are various comments about the signs being pants. Also go back to the school uniform shop and ask the manager there for contact details for the retail park (which I've Googled & Googled and got nowhere).  The school uniform shop will just be tenants of the retail park, they won't be able to do anything.  It will be the retail park that called EPC in, and we've seen loads of cases where the organ grinder has intervened and called off the monkey.  As for EPC, aye, ignore them until LoC stage.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

•Austerity is self-defeating. In a recession, governments who cut spending hard, have seen a large fall in nominal GDP. E.g. in 2011, Greece had a fall of 6% in GDP. This has led to a shrinking of tax revenues. Debt to GDP has continued to rise. In other words, austerity has reduced economic growth so much that the budget deficit has failed to improve.

•Recession is not the time for austerity. Austerity should be pursued when there is strong economic growth.

•Canada’s deficit reduction was successful because it could loosen monetary policy, devalue exchange rate and benefit from strong export demand to US and rest of world. Many Eurozone economies can’t do this. They can’t devalue, they can’t pursue expansionary monetary policy – they can’t rely on exports to recover – because the whole Eurozone is weak.

Austerity will never work, because although you will see the deficit number reducing, you get into a vicious circle of cutting to deal with issues it creates. If you don't spend money on roads for example you get increased traffic and that means you hit productivity. NHS has seen spending rise insufficient to cover all costs, therefore many Hospitals are in debt, which will need to be dealt with. Councils receive less money e.g care budget cut therefore more older people staying longer in hospital, costing the NHS.

 

Most of the debt has been added by coalition and Tories. When Labour left office in 2010, the debt was about £590 billion and the economy was growing. It now stands at £1600 billion, after the first 3 years of the coalition had very little growth.

 

Had the coaltion made investments straight away in getting houses built and other infrastructure projects started, i think we would be in a much better position. Some cuts would have been needed, but some tax increases would have been needed as well. The Tories decided on mostly spending cuts and some tax reductiions, hoping to see consumer spending increase. But the austerity has caused lower real term wages and consumers have cut back. Therefore business makes less profit and pays less tax.

Isn't it odd that in the EU countries like Germany who are social democrat (ish) by nature insist on the like of Greece following the direction of the world bank and the Washington consensus of liberalise , privatise and reduce the role of the state .

All because The U.S.A contribute most to the world bank and the IMF and therefore in reality control what it does

A bit off topic but as you mention the USA, have you noticed when they get involved i.e FIFA and the FBI something gets done.

 

I think a world supremacy maybe the ultimate goal, but we are way way in the infancy of that. With ref to Greece you have to look at the management of their own internal affairs. For Greece it's just a wake up call to look at the housekeeping. I see that as just common sense. To bring countries together into a club all at different economic situations is a mammoth job, lots to negotiate. I'm just a human being watching and reading as we all do to try and see what the future holds.

Yes that is true

 

The other thing to mention is greater use of technology, which means less human labour, more part time working etc.

We are born to live, not work.

We must do away with this absolutely specious notion that everybody has to earn a living, we keep inventing jobs because of this false idea that everybody has to be employed at some kind of drudgery because, according to Malthusian-Darwinian theory, he must justify his right to exist.

 

Austerity is simply another way of controlling the population.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Great lets all pack up work then.

No NHS-No schools-No houses to live in, no welfare payments/family allowances/housing allowance

no food in shops as their would be nobody to produce it-and nobody to sell it as their would be no payment for working!!

Great I love it, What are you going to do for the rest of your life??????????

I am hurt. I thought I held that honour. I must try harder.

 

In support of BB we should work to live but with capitalism we sre required to live to work, unless we are the bourgeoisie when we can sit on our million a week yatchs and spend 10k on a dinner party when water aid are asking the ordinary people for £3 to stop people dieing

Well I for one have an ambition to make the world a more egalitarian place where people all have enough food to eat and enough clean water . How any capitalist can sleep at night is beyond me when they know that they are getting richer on the backs of the workers in, for example China and Bangladesh
