hi i am new to this site and have a question 3 years ago i was caught for shoplifting and went to court i was fined £35 and given a condition discharge , i had been caught before that and given a £80 fine as it was my first offence. my question is i have been told that if someone is caught again after a year has passed they would just get a fine and would never go to court is this true ? thanks

Hi and welcome to CAG

 

The answer is NO. If the police got involved and based on the previous behaviour, the CPS could take court action where you may get another fine or something more serious.

 

What your friend is on about is a claim from a civil recovery company. The two main players are RLP (the biggest) and DWF who will write demanding some figure or other which can only be enforced if they (the store) took you to the county courts.

 

The easiest way to avoid this is not to steal in the first place.

live and learn. If in doubt, just dont do it. You have your punishment already. Time to learn from your mistakes.
