    Default Welcome Finance PPI

    Hi there I need some help I too was misold PPIicon and I am trying to get some help , I have been told by the wonderfull Welcome that I will only get a partial refund and it will ccome off the agreement my payments will stay the same.

    Is there no way I can get a full refund plus the money in cash, I do not want to have this taken off the agreement at the end.

    What do I do I would appreciate any help

    mmmm Lloydsicon TSB tried that line with me..yeah right.. Stuck it out and eventually got a cash refund of the premium plus interesticon..

    I have PPI WITH BLASTED WELCOME

    THEY HAVE OFFERED ME A PARTIAL REFUND AT THE END OF THE TERM BUT WILL NOT GIVE ME A FULL REFUND CAN ANYONE HELP WHAT SHALL I DO?

    Hi there the loan was a car loan taken out 2 years ago and has 3 years left to run, car was £5000 pay back about £9000+ not exact;y sure withouit looking PPIicon was extra about £2000+ they have offered to pay me back half but whta they are saying is that I bougt the car for Sanderson Motorhouse who are nothing to do with Welcome and that Welcome are not prepared to pay the full amount back as they did not force me to buy this product they said they cannot find anything on my files I have said I am speaking to my solicitor because they told me on the telephone i had to take this PPI out.

    Hi there

    I'd suggest that you have a good look for the original agreement. This agreement will list everything and will quote all interesticon rates etc., If you cant find it then right to them quoting the Consumer Credit Act (do a search for template letter to send to them - you will find it in legalities section where people are looking for an original copy of their agreement). Have a good look through that section and familiarise yourself with the Act and also the type of thing you will be dealing with. There is a thread in this forum which sets out the correct way to claim back PPIicon. Have a look at that. It will give you most of the information you are looking for. You can then ask questions if you are unsure about what to do.

    It sounds to me as if they are just trying to pass you off and hope that you will go away. The best way to deal with something like this is to arm yourself with all the information you need to succeed. This forum has a wealth of information at your fingertips but you do need to search and read quite widely around the subject and you also have to have your original documents so that you know the exact figures.

    Thanks I am not sure though what to do I have already sent in a letter which the chap branch manager phoned me, he says that they did not record the calls etc, at this time and he cannot see how I WAS FORCED TO TAKE THE PPIicon When I did not deal direct with a salesperson.

    Hi,
    You really need to get hold of all the original documents, agreements to see excatly what the costs for the loan and the cost etc for the PPIicon.

    What I can make of the above (correct me if I am wrong), you took the Loan out through Sanderson Motorhouse to buy the car, They would have been acting as Agents/ Brokers for Welcome Finance. If that is the case you will have to take your complaint up with Sanderson Motorhouse regarding the mis selling of the PPI. As welcome will have stated Correctly that if you did not set the agreement up directly whith them they cannot be responsible for mis selling the PPI.

    I have a similar ongoing case against GE Money/Purpleloans, they were acting as Agents for Firstplus. I have been fighting over this one since September this year, so it may be a long slog to get it sorted out with Sanderson Motorhouse.

    PPI is optional, well it should be, but there is far too much hard selling goes on with PPI, I was told no PPI then NO Loan..thats Crap..

    The mis selling of PPI is a new area really for reclaiming, I have had 1 success a while back, but you could have a fight on your hands, what it will come down to in the end is your word against theirs.

    The more information that you can gather the better, Once you have all the Information we may be in a better position to advise / help etc.

    But it is nothing to do with Sanderson, they are nothing to do with Welcome they did not do anything or say anything about the ppe it was ourely with Welcome, they told me over the telephone that I had to take this out.

    I thought that they had arranged the finance for you ..No problem.

    The best way to proceed is to Submit a S.A.R - (Subject access requesticon) under the Data Protection Act to obtain all the agreements etc that they hold regarding your account. Also state in your SAR that the information that you reguire also includes any transcripts of telephone conversations. I know you said they told you that they did not record calls, I find this a bit hard to believe that they do not at least record a percentage of calls. At least if you ask for any transcripts of calls and they dont supply any..they cannot obviously turn up should the case go to court with a copy of a recorded telephone callicon as evidence.

    You have to just think about covering every avenue, After all they told you No PPIicon then no Loan and that is total nonsense,and they know it.

    The more Information that you can gather puts you in a far better position to fight your case with them.

    Default Ppi Welcome

    Hi there
    Just received a letter on behalf of Welcome from Netcars who were the broekers when I bought my car over 2 years ago.

    Need some help on this one


    They have said that they did not missell the policy to me the member of staff no longer works fro Netcars and I should contact Welcome as they have offered me half of the refund as a good will gesture as a ex gratia payment.

    I do not know what to do now Welcome would not give me the money in cash wanted to add on to the end of thepolicy also netcars waffled on about you Signed the policy Blah Blah Blah, same usual waffle fobbing us off .
    The letter says contact the finnancial Ombudsmanicon.

    Hi,
    I would say that your complaint should be well and truley with Netcars, they sold you they product and are liable for their actions. Even though the salesman involved no longer works for Netcars, Netcars themselve have Vicarious Liability for the Actions, Omissions and Misrepresentations of the salesman who was an employee carrying out duties on behalf of Netcars.

    I am currently fighting a very similar thing with GE Money, they were acting as Brokers for Firstplus at the time took out a loan. My complaint re the PPIicon issues are with GE as it was their salesman that mis-sold me the policy.

    Do not appear to be rude, but

    Why, oh why would they give you half of a refund, because they felt like being nice.

    I am not an expert, but personally if they offered me half I would view that as an admission to guilt to mis-selling and they are trying to fob you off with half, If you pursue this you will get it all. I am having this problem with a company who has admitted it, in so many words, and they are just trying to shut me up with a token payment and hope that I will accept it and go away. I won't!!!!

    Where are you up to, have you sent your prelim letter asking for the full refund. Is it your letter before actionicon. If they are offering this goodwill gestureicon at the lba stage, I would start the small claims court.

    They have to know that you are serious in this, otherwise accept the goodwill gestureicon, they win and keep the rest.
