Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have followed the timescale and procedure correctly so far and so have completed all of the required letters. However the response to my SAR was the usual microfiche thing so I had to estimate my charges based on the charges I know were applied for the period I received statements. Anyway the only responses I've had from Barclaycard are that they're looking into it and are hoping to reslove the situation by 5th December!
Anyway following my timescale I need to file a court claim tomorrow. The trouble is I still don't know the exact charges. Should I go ahead anyway based on estimated chrges? If so do I need to adjust the particulars of claim from the template provided? Also what about interest? Any help would be appreciated.
Hi antony
There's loads of people in the same situation as you atm, me being one of them.
You don't have to file your claim tomorrow. You can file whenever you want, as long as you have given The Evil Ones () the appropriate time to respond, which you obviously have.
Personally, I'll wait until Barclaycard have had their ICO visit (I take it you have read about this?), and hope to then be in a stronger position to argue.
I know I'm not giving you any solution, but in the end it is up to you and no one else what you do. Basically I just wanted to tell you there is no need for you to hurry into a claim.
Whatever I post is just my opinion, no more, no less!
