Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi.
I am in the process of a couple of claims, but this one is on my husbands behalf.
We live in England but I am claiming his bank charges back for him from RBOS (obviously he is signing the forms). The account is now closed as it was his students account.
Posted SAR and £10 on October 9th, received all statements within 4 days and I highlighted charges which amount to £342.
I sent the prelim letter on Oct 23rd which gave them til Nov 7th to respond. So far they haven't so I'm at the next step.
A couple of things are:
Is the address Inverness Chief Office, Inverness the correct place to post to?
Also, if this comes to the court stage will we need to attend a court in Scotland?
i'm at the court stage of my claim. i sent all my letters to the branch i opened my account in the local town.
as far as the courts are concerned you can do it all by mail or e-mail. i did my summary cause claim by mail. obviously you would have to go to the court if the bank put up a defence but i don't think this has ever happened.
Does this mean that I need to re send a prelim but to London, or just can I send the lba to the London address.
My husband is Scottish so all of his relatives live in Scotland so he does have a Scottish correspondance address if need be.
Also, what is a summary clause claim - I have scoured the boards for months but i have not come accross that phrase before.

summary cause claim is like a small claim (same form, different title) it just means you can claim more back in one claim. small claim £750 max, summary cause claim £1500 max.
Personally I think its best to send everything to your branch - they know you and your account more. It worked for me anyway! You quite often get a faster response as well as a named person to respond to and direct any future mail towards.
If and when it comes to court stage as you're in England you can use the London address to serve on (or your branch if its in England) then you can do it through MCOL, or through your local court the old fashioned way!
It might be a good idea to phone and check if anyone received your prelim wherever you sent it to.
Good Luck

The prelim was sent to the Chief Office address in his ex-local town in Inverness. The account was closed in 2004 as it was just a student account and we transferred into a joint account with Shabbey (but that's a whole other thread!) It was definately received because I posted it on 23rd October via recorded delivery and it was signed for on Oct 24th. I have waited a few extra days just to see if any letter was on its way but we still haven't received anything.
I will ask my husband to phone the Inverness branch in the morning to see what is happening.
I will post back tomorrow but I think I will just keep my lba as going to the same Inverness address and then if it comes to a court stage I will use the London one to serve on.
