    • Yep, I agree with what you are saying, I only mentioned the governing body code of practice as a nod to the fact that I wasn't dismissing the BPA or whoever out of hand, thought that would go in my favour before a judge. I wrote a long post about the BPA CoP earlier but then deleted it because I realised I wasn't talking about points of law but a set of guidelines drawn up by one bunch of charlatans for another bunch of charlatans. It is ludicrous that the 5 minute consideration period doesn't apply if the motorist parks, such nonsense. As for legislation, I was referring to the government legislation (if it is legislation?) document which has been withdrawn. Does that stand until it has been reintroduced? In the explanatory document it is quite clear. Otherwise, how does one hold them to the consideration and grace periods? Or is that at the discretion of the judge?
    • Thank you all   JK, I agree; if they were to accept my full claim today, then the interest would be around 8-9 pounds. If I were them, I would have offered to pay the interest and said no to the 12 pounds for the letters. These have not been mentioned, which is my mistake.   As you pointed out, if the judge were to award at 4% and I did not get the letters, I would get less.   Bank, thank you. I do hear what you are saying. If I am to continue with this, then I will need to pay an additional trial fee of £59. If I win everything, then great, but if I win less the claim and court fee, then I lose out. I am not sure what the judge will think about the interest. I think we have to remember that I won the item and, therefore, did not pay a penny for it. Yes, I have had to purchase an additional one, but maybe the judge will hold this against me. I am content that this is a win. I have not signed any non-disclosure clauses, and they do not ask for this either in their offer. 
    • Are you saying that both businesses were closed? Yet you stayed there for over two hours. . If both were closed than to charge £100 is a penalty since Horizon had no legitimate interest in keeping spaces clear for the company. sake as there were no customers..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

after several years of depression and spiral debts I now want to sort out my pay day debts.

I am currently with Pay plan but currently repayment will mean I am 80 before debt free.

 

 

Looking for advice to get debts reduced due to irresponsible lending.

I am not trying to get out of the debts just reduce interest they currently have charged

 

Quick Quid after 8 roll overs borrowed £750 paid £269 Currently with Arc still owe £1107

 

Swift borrowed £150 now with CCM paid £72 still owe £265

 

pay day express after several rollovers borrowed 750 still owe 1200

 

Nat west went overdrawn by £10 charged me £250 in bank charges

 

Lending stream took out 4 loans 750 in total charged £2000 reduced to 1600

 

Most were irresponsible as they loaned money even though I had defaulted on a a payday loan

 

 

Lending stream I defaulted and they still allowed to take another loan.

 

 

They also went to my account 44 times one night and each time tried to take £5.00 till the bank stopped after 4th attempt

 

How do I start to ask these companies to take off interest.

 

 

My memory regarding the loans is a little sketchy as I was suffering from depression and don't even know if I took all them out

Complain to Natwest for a start, they may have a 1 time offer to remove charges.

 

Also move your bank account to another non associated provider. Reason being is because you dont want them to poach your money without you even knowing. (If you cancel your DMP then that will happen)

44 Times?!?!?!? When was this?

 

You could potentially have them as they are only allowed to use CPA TWICE!!!

I have complained to Nat west on phone only so I might try a letter.

They refused to accept a payment plan so the charges just escalated until I joined payplan.

 

Lending stream were the payday loan that used my debit card to take money out when I missed a payment.

 

 

I borrowed $800 over 4 loans and have paid back over £750

they agreed to write off £600 and I still owe over a £1000.

They were the company that went to my account and tried to take £5.00 out 44 times until the bank stopped them.

I have moved account.

 

Just wondering if I get these people to reduce the interest they are charging

Open a new bank account ASAP, with a different banking group.

 

Pay Natwest the ten pounds you went overdrawn, then ignore them.

They WILL NOT take you to court for a debt made up solely of their penalty fees!

 

Have you told these loan sharks, in writing, that you cannot meet the payments?

If not do so, and you need to demand that they stop interest and charges on these accounts, or you will be forced to pay them off at a £1 a month for the life of the debt.

 

Whilst payplan are good, they will not ensure that these lot have the legal rights to make you pay.

 

There is clearly irresponsible lending here, and this avenue should be looked into and exhausted.

 

How many and who are your creditors?

What is the state of play with each of these accounts?

Have you defaulted on them and have they sent you any default notices?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

RBS Group are currently not entered into any debt sale agreements.

So court wont happen for now.

 

Follow BBs advice. I would advise the same.

Thanks for advice.

Now complained to RBS and lending stream.

 

 

I have told lending stream i will complain to FOS as they gave me 2 more loans even though I had missed payments on one .

 

 

They raided my account on several occasions and took out money without telling me.

At the time I was suffering from depression and may sound ridiculous but did not even think of changing banks.

I did not know I could stop them by contacting the bank.

I ended up borrowing more from payday loans just to buy food after they raided my account.

 

I have already paid back what I borrowed but payment plan of £20.00 a month means I will have to keep paying for another 5 years because of the interest!!

I know I sound really stupid was I was just getting over cancer and having a mastectomy and ended up gambling which spiraled out of control.

 

Now gambling free and just want to sort out debts. but not by giving into these leeches who have robbed me of everything including my dignity

 

RBS passed my dept on to triton who phoned me regularly telling me if did not repay the £4000 I owed they would put a lean on my house.

One night they told me I would have to borrow the money from someone else or they would start legal proceedings and bailiffs would be sent

 

I had a PPI case RBS they told me they would settle for £2000 but would have to drop PPi case.

As I did not how much I would get I said no.

I finally got £2500 from RBS and then this year some money for fraud online protection charges.

However they would not refund all money only went back 7 years.

 

I have contacted them and said I want the remaining £700 written off and compensation for the way I have been treated.

I feel after the money they have had to repay I did not actually owe them anything.

They have returned late payments etc. and if they had returned the fraud online charges for the actual 12 years I had been paying I would be in credit

Well thats some good news! :)

Triton are RBS in sheep's Clothing. Trust me, I know this!

 

Shame you didnt record these calls, the FCA would have had a field day with them.

Dont worry about Triton

 

They wont do anything! There are harmless. RBS isnt currently in Debt Sale so chances are it wont go anywhere for now. Why not complain to the execs?

Currently with payplan could not take the stress of constant phone calls and letters

but want to also now take control and not just roll over.

I have paid back more than I borrowed to Lending stream and feel enough is enough.

 

As RBS if I do not hear anything this week i will contact FOS, they had to get involved to get back my PPI.

Also, if they're not stopping interest, drop them to £1 a month until they do

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Thanks contacted FOS regarding Lending stream and they said they would contact the company.

 

 

I also complained to lending stream who said they would investigate.

 

 

Hopefully they will write off the remaining balances as I have already paid them back what I borrowed and interest and this just more interest,

Hi

Thanks for all advice I am currently in DMP .

Lending stream have reduce one loan so now owe only around 1400.

However i have paid back more than I borrowed.

So currently emailling them on a daily basis with proof their lending was irresponsible.

They said I had a credit score of 600 but at the time I had 10 defaults over 4 months in arrears with mortgage and defaulted on a payday loan.

I do not want all the money back just the interest I have been charged.

 

Natwest are sticking by guns however their letter contains some interesting statement that I would like help on

 

I can confirm that once your account was passed to Trition credit due to breaching terms and conditions your balance became legally due in full.

Trition provided you with the correct information that the balance was due in full immediately legal proceedings could be take against you to recover the debt.

It was their process at this time to ask customers if they ware able to borrow funds form elsewhere

and they were able to offer settlement figure.

( They did not offered settlement just told me to pay the amount)

They had froze the interest so why would I borrow and incur more debt?

 

PPI and CPP are both external insurance companies and not part of Natwest.

I am sorry therefore I am unable to provide you with a breakdown of how your payments were made up.

I enclose statements from when your PPI was refunded.

 

They only have to go through my statements and add up how much they debited for PPi and CPI.

Now I guess I will have to pay £10 for copies of all statements to show they did not give me a full refund

 

Any help on reply to them would be gratefully appreciated

A Subject Access Request will cost you £10.00 and the bank will have to provide you with all the data they have in respect of your financial history with them ?

Success quick quid wrote off debt and gave £150 for trouble was not expecting that

Waged day advance refunded all interest

Nasty west wrote off bank charges £453

Halifax wrote off ban charges £330

Lending stream now with fos

Rbs refuse to budge asking for statements so I can check correct amount paid

D back for poi and fraud insurance

Well now, that is very good news for the most part.

 

In respect of RBS, have you sent them a Subject Access Request - yes, it will cost you £10.00 however, it should provide the information you required.

 

You could of course make a formal complaint to their Head/Registered office and then escalate to the Ombudsman if you don't receive a satisfactory response.
