    Default I'm in the wrong but fine is £50.00!!!!!!!

    Hi

    I hope someone can advise.

    I parked for a few minutes in a disabled space in a retail park (Yes I know im not fit to burn!!!). I got a ticket and expected it to be about £20.00 - £25.00. Which I would have been ok with paying.

    To my horror it was £50.00. Are they within their right to charge this amount?

    The ticked was issued by a private company called CMS based in St Annes, lancashire.

    Also they are saying that if I want to appeal I have to send them the full amount money first and then if my appeal is successful thay will refund it?

    Is this the way its done? Or is this a trick so I am in a no win situation?


    Any advice would be greatly appriciated.

    Pay up as you were in the wrong regardless of what you though. Were you displaying a disabled badge ?

    I take it this is a charge from a private company in respect of a contract entered into for provision of a parking space on private land, and not a fine from a local authority or an agent acting on their behalf etc?

    If yes you could ask them for evidence of who it was that entered into the contract with them for provision of the parking space. Just because you may be the registered keeper of a car doesn't mean it was you that entered into the contract with them. A third party can't enter a contract on your behalf, and if this isn't something involving the police or a local authority or their agent then you have no obligation to tell them who might have had the use of your car that day.

    Sorry, usually I don't like lectures but on this subject I do have to agree. People parking in disabled spaces make me want to become a temporary Parking Attendant and give out fines.

    The opening poster stated that she was the person driving the car - any suggestion that someone should lie their way out of payment is totally against what this site stands for.

    What if they are disabled?

    Anyway, I'm sure you wouldn't in this case of course, because it took place on private land and any attempt to levyicon a "fine" would be unlawful.

    Personally i now always carry a angle grinder when i am out and about. to date i have had to grind off 2 clamps. I am not saying this is legal but in the circumstances i would say it is. As if you get clamped. You have to pay first and then argue the toss over everything. Now i cut their clamp off and they can argue the toss over the damage etc and going to court if needed afterwards. I have not had the police intervene except to ask why i did it.
